Fresh chilled or frozen products must be delivered in accordance with Canadian Food Inspection Agency requirements stipulating that frozen products must be maintained at -18o C or lower, and fresh chilled products between 4o C and 1o C until delivery. All fresh chilled or frozen products must be delivered in refrigerated vehicles and show no evidence of deterioration. Frozen products must not have been frozen for longer than 90 days since the date of processing in the fresh state.

Use the following clause in contracts described below when the contractor is located outside of Canada and the Department of National Defence (DND) is responsible for shipping:
- sole source contracts for goods;
- all repair and overhaul contracts where transportation was not part of the competitive bid; and
- contracts for United States Foreign Military Sales.
Use this clause in conjunction with C2608C for all shipments when DND will be the importer; and with C2610C when DND will be the importer and the contract value is CAN$250,000 or more.

- Delivery will be FCA Free Carrier at _________ (insert the named place, e.g. Contractor's facility) Incoterms 2000. The Contractor must load the goods onto the carrier designated by the Department of National Defence (DND). Onward shipment from the delivery point to the consignee will be Canada's responsibility
- Before shipping the goods, the Contractor must contact the following DND Inbound Logistics Coordination Center by facsimile or email, to arrange for shipment, and provide the information detailed at paragraph 3.

In addition, the Contractor must send to ILUK the completed form "Shipping Advice and Export Certificate" by email to: CFSUEDetUKMovements@forces.gc.ca.
The shipment of any items above the value of 600 GBP (pound sterling) being exported from the United Kingdom and Ireland will be cleared by DND using His Majesty's Customs & Excise (HMCE) New Export Systems (NES). The Contractor must comply with HMCE requirements by registering with HMCE or by having a freight forwarder complete the entry. A printed copy of the NES entry Export Declaration clearly displaying the Declaration Unique Consignment Reference Number must be provided by the Contractor and attached to the consignment. The Contractor must ensure that this procedure is carried out for all stores whether they be initial purchase or repair and overhaul export items. HMCE will authorize Canadian Forces Support Unit (Europe) to ship the goods only if the procedure has been adhered to completely and properly by the Contractor. Canada is responsible for the carrier selection for shipments of the goods supplied under this FMS contract. Instructions on how to obtain carrier selection from Canada are contained in U.S. Department of Defense 4000.25-8-M, Military Assistance Program Address Directory, and Canadian Special Instructions Indicator (SII). The Contractor must not ship the goods until the SII has been complied with.- The Contractor must provide the following information to the DND Inbound Logistics contact when arranging for shipment:
- the Contract number;
- consignee address (if multiple addresses, items must be packaged and labeled separately with each consignee address);
- description of each item;
- the number of pieces and type of packaging (e.g. carton, crate, drum, skid);
- actual weight and dimensions of each piece type, including gross weight;
- copy of the commercial invoice (in accordance with clause C2608C, section 4, of the Standard Acquisition Clauses and Conditions Manual) or a copy of the Canada Border Services Agency form CI1 Canada Customs Invoice (PDF 429KB) - (Help on File Formats);
- Schedule B codes (for exports) and the Harmonized Tariff Schedule codes (for imports);
- Canada-United States-Mexico Agreement Certification of Origin (in accordance with clause C2608C, section 2) for the U.S. and Mexico only;
- full details of dangerous material, as required for the applicable mode of transportation, signed certificates for dangerous material as required for shipment by the International Maritime Dangerous Goods Code, or International Air Transport Association regulations or the applicable Canadian Dangerous Goods Shipping Regulations and a copy of the safety data sheet.
- Following receipt of this information by Canada, Canada will provide the appropriate shipping instructions, which may include the requirement for specific consignee address labelling, the marking of each piece with a Transportation Control Number and customs documentation.
- The Contractor must not ship goods before receiving shipping instructions from the DND Inbound Logistics contact.
- If the Contractor delivers the goods at a place and time that are not in accordance with the given delivery instructions or fail to fulfill reasonable delivery instructions given by Canada, the Contractor must reimburse Canada any additional expenses and costs incurred.
- If Canada is responsible for delays in delivering the goods, ownership and risk will be transferred to Canada upon expiry of either 30 days following the date on which a duly completed shipping application is received by Canada or by its appointed forwarding agent, or 30 days following the delivery date specified in the Contract, whichever is later.

INSPECTION AND STAMPING PROCEDURES FOR MEAT PRODUCTS CONSIGNED TO THE DEPARTMENT OF NATIONAL DEFENCE: 1. All shipments of meat products consigned to the Department of National Defence (DND) must be inspected and stamped as complying with all individual contract specifications by an inspector of the Food Products and Inspection Branch, Agriculture Canada, prior to shipment. IT IS THE RESPONSIBILITY OF THE REGISTERED ESTABLISHMENT AWARDED A CONTRACT TO ENSURE THAT: (a) the inspector is notified and is given a copy of the contract; and (b) there is in the possession of the management, the latest issue of the Canadian General Standards Board standards respecting the contract; and these are available to the inspector-in-charge. This is to be confirmed by a letter issued by Department of Public Works and Government Services (DPWGS), signed by plant management and the inspector-in-charge and returned to the area office of DPWGS. 2. It is a contractual obligation that meat products for the Department of National Defence be inspected, stamped with the official stamp, and date marked at the PLANT OF PRODUCTION. In the case of processed products with a label approval number specified on the contract, the stamping and date marking may be done at the shipping establishment. Plant management must ensure that any product leaving their plant for shipment to DND has been properly stamped by the inspector. A rubber or brass stamp marked "Agriculture Canada Insp. (number)" for G.C. is available on request. The stamp must remain under the control of the inspector-in-charge. A log of each occasion when the stamp is used shall be kept indicating date, stamp number, type and quantity of product, destination and contract number. 3. After the inspector has verified that the shipment meets all contract requirements and that each container has been date stamped, each container must be legibly stamped using the "Agriculture Canada Insp. (number)" for G.C. stamp prior to shipment. In the case of beef carcasses, each quarter must have two stamp impressions or eight per carcass. Hog, veal, lamb and mutton carcasses must have three stamp impressions per side or six per carcass. 4. Inspectors are to document all in-plant rejections of meat products destined for DND by cause and notify their regional office which, in turn, will notify DPWGS.

Manufacture, repair, overhaul, installation, inspection and tests for each such item identified in the requirement must be documented in accordance with the requirements of the above mentioned CFTO.
For each such item, the Contractor must provide a Certificate of Conformity [form DND 2513 or locally produced equivalent approved by the Quality Assurance Authority (QAA)] in accordance with this CFTO. For subcontracted work, the Contractor must obtain that Certificate of Conformity from the subcontractor. The Contractor is responsible for performing, or having performed, all inspections and tests necessary to substantiate that the material or services provided conform to the requirements of the Contract.
The Contractor must provide, at no additional cost, all applicable test data, all technical data, test pieces and samples as may reasonably be required by the QAR to verify conformity to the requirements of the Contract. The Contractor must forward at its expense such technical data, test data, test pieces and samples to such location as the QAR may direct.

One portion must be tested by the Contractor's test facility. The other portion must be tested by a facility meeting one of the following criteria:
- an independent, arms length third party laboratory accredited by the Standards Council of Canada (or other nationally or internationally recognized laboratory accrediting body) to conduct the tests identified in the item specification(s) or
- an independent, arms length third party laboratory operating a ISO 17025:2005 system, and participating regularly in a recognized proficiency testing program for the contracted product(s).
- Each portion must be tested to all requirements detailed in the item specification(s). The Contractor does not have to conduct tests identified by the specification(s) as qualification tests only. The Contractor does not have to conduct a test on the first batch of items if the above program for sampling and testing has been conducted within six (6) months of the date of the Contract.
- The Contractor must, on receipt of the third party test report, compare the results received with those of the Contractor's own test facility. Any deviation between results obtained by the two test facilities in excess of the reproducibility of the test methods involved, must be investigated, the root cause determined and corrective action taken.
- The Contractor must repeat the above program for sampling and testing at least once every six (6) months during the life of the Contract.
- The purpose of this correlation testing is to verify the quality of the contracted item(s) and to validate the capability of the Contractor's testing facility. The test report(s) received from the third party laboratory, the Contractor's test reports for the same batch(es) of contracted item(s), reports of any investigations of deviations of the results obtained by the two laboratories and any corrective actions taken, must be made available to the Quality Assurance Representative on request. It is not intended that the Contractor be registered to ISO 9001; however, the Contractor's quality management system must address all requirements appropriate to the scope of the Work. Only exclusions in accordance with clause A.5 and 4.3 of ISO 9001 are acceptable.
Assistance for Government Quality Assurance (GQA)
The Contractor must provide the Quality Assurance Representative (QAR) with the accommodation and facilities required for the proper accomplishment of GQA and must provide any assistance required by the QAR for evaluation, verification, validation, documentation or release of product.
The QAR must have the right of access to any site of the Contractor’s, sub-contractors or any sub-tier external providers of goods and/or services where any part of the Work is being carried out. The QAR must be afforded unrestricted opportunity to evaluate and verify Contractor conformity with quality system procedures and to validate product or service conformity with the requirements of the Contract. The Contractor must make available for reasonable use by the QAR the equipment necessary for all validation purposes. Contractor personnel must be made available for operation of such equipment as required.
When the QAR determines that GQA is required at a subcontractors or external provider's facilities, the Contractor must provide for this in the purchasing document or other documented means and forward copies to the QAR, together with relevant technical data as the QAR may request.
The Contractor must notify the QAR of non-conforming product or service received from a subcontractor or external provider when the product or service has been subject to GQA.
For the design, development or maintenance of software, the Contractor must interpret the requirements of ISO 9001:2015 "Quality management systems - Requirements", according to the guidelines of the latest issue (at contract date) of ISO/IEC 90003:2018 "Software engineering - Guidelines for the application of ISO 9001:2015 to computer software".

All installation work shall be subject to Government Quality Assurance (GQA). The Quality Assurance Authority for all work provided under this Contract is the Director General Quality Assurance, Department of National Defence, MGen George R. Pearkes Building, Ottawa, Ontario. K1A 0K2, or his delegated representative. At least 30 days prior to the commencement of work at the installation, the Contractor shall make arrangements for on-site GQA with the Director, Quality Assurance Operations, Site Installation Supervisor, (613) 996-4625. The Design Change, Deviation and Waiver Procedure as defined in National Defence Standard D-02-006-008/SG-001 shall apply to this Contract. All work performed by the Contractor at the installation site shall be controlled and inspected in compliance with the requirements of AQAP-4, NATO Inspection System Requirements for Industry. Quality Control and Inspection records shall be retained by the Contractor for a period of three (3) years from the date of completion or termination of the Contract. The Contractor is responsible for delivery, installation and proving of the equipment. The equipment shall remain the responsibility of the Contractor until accepted by an authorized DND representative. Proof of Government Quality Assurance is required in the form of properly completed release documents. Such proof is required by DND prior to payment of invoices. The Contractor and any of his subcontractors shall ensure that all test facilities used for Electromagnetic Compatibility (EMC) compliance testing are recognized by DND as having the necessary specific capabilities. They shall further ensure that all facilities in the United States to be used for EMC compliance testing are recognized under the National Voluntary Accreditation program (NVLAP) as having the necessary specific capabilities. Facilities other than Canadian and U.S. must be recognized under an equivalent certification program that is acceptable to DND. Contractors and subcontractors with test facilities not recognized, but used to perform EMC compliance testing, shall take action to have their capabilities reviewed prior to commencement of any EMC compliance testing and the facility must be acceptable to the DND Quality Assurance Authority. Testing will be witnessed by government personnel when judged necessary by the DND Quality Assurance Authority or his/her delegated representative. This requirement is in addition to any other quality assurance clauses. Where the necessary and specific capabilities for EMC compliance testing are found lacking, no further testing shall proceed until such time as the Contractor rectifies the situation to the satisfaction of the DND Quality Assurance Authority or his/her delegated representative.

1. For the purposes of this requirement, the following working hours and overtime periods shall apply: (a) A normal working day shall be any 7.5-hour period between the hours of 7:00 a.m. and 5:00 p.m., Monday to Friday inclusive, and totalling 37.5 hours per week. (b) Overtime Monday to Friday will commence after 7.5 hours of continuous work each day. (c) Overtime Saturday and Sunday will be any period worked either Saturday or Sunday. 2. Travel beyond a 25-mile radius of the work site will, when authorized by the Department of Public Works and Government Services (DPWGS) Inspection Office, be paid in accordance with Treasury Board Travel Directives for the Public Service, current issue in force at the time, and such expense incurred shall be paid without any allowance for overhead or profit. 3. No allowance will be made for any removal expense incurred by the assigned personnel either to or from the work area. 4. During the term of the Contract, the scheduling of vacation time and /or time off for the incumbent shall be as per agreement with and the prior approval of the DPWGS Inspection Office, whose prime concern will be to ensure adequate staff is available at all times.

1. In order to avoid any real or apparent conflicts of interest, the Contractor hereby agrees that it will not, during the term of the contract, undertake or perform services on behalf of, or contract with the Shipbuilder - _____. 2. The Contractor further agrees that it will ensure that personnel provided, pursuant to this Contract, shall devote their full time and attention to the performance of the services to be provided hereunder and will not, therefore, be in a position of any possible conflict of interest during the term hereof. 3. - The Contractor must strap, and if necessary wrap, shipments on standard 1.22 m x 1.02 m (48 in. x 40 in.) wood pallets. The four-way forklift entry pallet must be supplied at no charge to Department of National Defence. Total height, including pallet, must not exceed 1.19 m (47 in.). The pallet load must not extend further than 2.54 cm (1 in.) from any edge of the pallet.
- The Contractor must group items by stock number (on the same pallet) within consolidated shipments. Pallet loads composed of more than one stock number must be marked as "Mixed Items".
- Individual items exceeding 1.22 m (48 in.) in length or 453.6 kg (1000 lbs) must be secured to larger pallets or must have 10.16 cm x 10.16 cm (4 in. x 4 in.) skids securely fastened to the bottom of the item. Skids must be separated by a minimum of 71.12 cm (28 in.).
- Any exception requires the prior approval of the Contracting Authority.

Use the following clause in contracts as a follow-up to clause A0301T, Military Aviation Replacement Parts - Substitutes and Traceability.

Records of the manufacturer sufficient to constitute proof of origin must be available for review, and must be retained and maintained by the Contractor for three (3) years following delivery of the last item under this Contract. Such records shall include the following: (a) sufficient information to identify the item by type, class, style, grade (including lot or batch number), cast number, the source of the part, and the date and place of manufacture, as appropriate; (b) the name and description (or other positive identification) of, and the application issue of, the specification, drawing, process and inspection requirements, as appropriate; (c) records of all inspections and tests carried out, including those carried out on behalf of either the manufacturer or the Contractor; (d) copies of any Certificate of Conformance or Certificate of Compliance issued by the manufacturer; and (e) all other relevant technical data.
