    ADVANCE CONTRACT AWARD NOTICE (ACAN) - TSB2024-8061448

    PART 1 – ADVANCE CONTRACT AWARD NOTICE (ACAN)
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

    PART 2 – DEFINITION OF THE REQUIREMENT
    The Transportation Safety Board of Canada (TSB) requires a Transport Canada (TC) certified pilot type rating on the Boeing 737NG (B73C) aircraft. This rating is a requirement of the investigator position (AO group CAI sub-group) for the purpose of TSB investigators completing their Professional Aviation Currency Program (PACP).
    The work will involve the following:
    - B73C Simulator Lease Non-motion
    - B73C Level D Simulator Lease Full-motion
    - B73C Instruction (classroom and simulator) provided by a Transport Canada approved check pilot – type A with approval to issue type ratings on B73C.
    - Transport Canada approved check pilot for the conduct of the flight test for the purposes of issuing an individual type rating, including instrument proficiency check.

    The solution must:
    - Offer simulator flight training in accordance with Canadian Aviation Regulations.
    - Offer a Transport Canada-certified Level D Boeing B73C simulator.
    - Offer Transport Canada-approved operational rating training.
    - Offer the services within the Edmonton Metropolitan Region of Alberta, Canada.
    - Offer a rate that ensures best value to the crown.
    - Offer training to ensure course completion before 31 March 2025.
    - Offer training between the hours of 0600 and 1800 local time (MDT).
    - Offer required recurrent 6-month courses, in the Edmonton Metropolitan Region of Alberta, Canada during working hours.

    PART 3 – CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES
    (MINIMUM ESSENTIAL REQUIREMENTS)
    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following
    requirements:
    - The vendor must have instructors with a Transport Canada approved check pilot type A rating to issue type rating on B73C aircraft.
    - That the aircraft simulators provided for the purpose of this contract are certified and maintained in accordance with Transport Canada regulations and approved policies and procedures.
    - The vendor must provide a Transport Canada-certified Level D Boeing B73C simulator and Transport Canada-approved operational rating training.
    - The vendor must provide a solution located in Edmonton Metropolitan Region of Alberta, and ensure compliance with all applicable laws and regulations.
    - The vendor must complete the training by 31 March 2025.
    - The vendor must offer the training between 0600 and 1800 hours local time.
    - The vendor must offer required recurrent 6-month courses.

    PART 4 – APPLICABILITY OF THE TRADE AGREEMENT(SC) TO THE PROCUREMENT
    This procurement is subject to the following trade agreement: Canada-Korea Free Trade Agreement (CKFTA)

    PART 5 – JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER
    The supplier mentioned in section 11 below is the only known supplier that offer and meets the mandatory criteria set out in section 3 above. Should Canada receive a statement of capabilities from a supplier that contains sufficient information to indicate that it meets the requirements set forth in this ACAN, a competitive process will be triggered with a technical and financial evaluation methodology of the bids proposed by the potential bidders.

    PART 6 – GOVERNMENT CONTRACTS REGULATIONS EXCEPTION(S)
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6. (d) only one person or firm is capable of performing the contract. The identified supplier, Advanced Aviation Training LTD, is the only one able to offer and meet all of the criteria identified in paragraph 3 above.

    PART 7 – EXCLUSIONS AND/OR LIMITED TENDERING REASONS
    The following exclusions and/or limited tendering reasons are invoked under the: Canada-Korea Free Trade Agreement – Article 14.3, Under the Revised GPA - Article XIII, 1 (b) (iii);

    PART 8 – OWNERSHIP OF INTELLECTUAL PROPERTY
    Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.

    PART 9 – PERIOD OF THE PROPOSED CONTRACT OR DELIVERY DATE
    The proposed contract is from Contract award to March 31, 2025. The contract includes an option to extend the contract period by up to one (1) additional one (1) year period under the same conditions.

    PART 10 – COST ESTIMATE OF THE PROPOSED CONTRACT
    The estimated value of the contract, including optional periods is $108,380.00 (Applicable Taxes extra).

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    PART 13 – CLOSING DATE FOR A SUBMISSION OF A STATEMENT OF CAPABILITIES
    The closing date and time for accepting statements of capabilities is November 15, 2024. At 2:00 PM.
