    Project Background
    Section 78.1 of the Ontario Energy Board Act, 1998 (OEB Act) and Ontario Regulation 53/05 Payments Under Section 78.1 of the Act (O. Reg 53/05), made under the OEB Act set out the OEB's authority to set payment amounts for Ontario Power Generation's (OPG) nuclear facilities and certain hydroelectric facilities.
     
    In December 2025, OPG filed, jointly with DNNP LP by its general partner, DNNP GP Inc., an application to the OEB seeking approvals relating to 2027-2031 blended payment amounts for OPG’s nuclear facilities and the facilities constructed under the Darlington New Nuclear Program [EB-2025-0297] (OPG Application). Within this application, OPG and DNNP LP seek approval of a custom incentive rate-setting framework with the following components [EB-2025-0297, Exhibit A1-3-2]:
    1. Custom index to set blended payment amounts for OPG’s nuclear facilities and the Darlington New Nuclear Program facilities for 2028 to 2031. In OPG’s proposal, 2028-2031 blended payment amounts would be set using annual revenue requirements adjusted by a stretch factor of 0.3%.
    2. Earnings sharing mechanism and off-ramp.
    Purpose and Objectives
    The purpose of this procurement is to retain an expert who will review and scrutinize OPG's nuclear incentive rate-setting framework, benchmarking research, total factor productivity evidence, and provide associated technical advisory services as required. This will require identifying strengths and weaknesses of OPG’s rate-setting framework, benchmarking research, and total factor productivity evidence and evaluating the impact of the proposed framework on rates and achieving the desired outcomes as per the OEB's Renewed Regulatory Framework (RRF). This may include modeling and scenario analysis to compare outcomes between established frameworks in the RRF and the proposed framework.     Scope of Work and Requirements
    As required, the successful Vendor will provide the following Services and Deliverables:

    Deliverable 1 - Briefing to OEB Staff and Interrogatory Support (expected date of late February / early March 2026
    Deliverable 2 - Technical Conference (expected date of April/May 2026)
    Deliverable 3 - Expert Report (expected date of April/May 2026)
    Deliverable 4 - Interrogatories on Expert Report (expected date of May 2026)
    Deliverable 5 - Oral Hearing Preparation (expected date of July/August 2026)
    Deliverable 6 - Oral Hearing Testimony (expected date of July/August 2026)
    Deliverable 7 - OEB Staff Submission (expected date of August/September 2026)
