Advance Contract Award Notice (ACAN):
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
The National Research Council Canada has a requirement for the supply of and install of a new Smardt chiller with magnetic bearing compressors in the Laser science division at the NRC. The contractor will be responsible to disassemble the Smardt chiller on site, bring components into sub-basement to reassemble and calibrate the system using Smardt’s pre-existing infrastructure (hardware/software).
Sole Source Justification for the Pre-Identified Supplier:
1. The following procurement is based on unification of systems and interchangeability of OEM (Original Equipment Manufacturer) parts, hardware & software platforms. The National Research Council has a requirement to add an identical Specialized Chiller for the Laser Science Division.
2. The proposal is related to commonality/compatibility with existing equipment. NRC has identical units already on inventory. In order to achieve commonality/compatibility with our existing controllers/hardware and software platforms we must purchase an identical units to ensure seamless transfer of processes and interchangeability.
3. The proposed will be installed in the sub-basement of 100 Sussex drive. The sub-basement has condensed space constraints and does not allow for large scale items to be handled or maneuvered easily. The proposed procurement is the only known solution that comes in small enough sections to accommodate our small space requirement.
4. This specialized chiller has unique features that until recently were not available in equivalent models. The proposed chiller was the first chiller to offer a nearly frictionless magnetic bearing. The magnetic bearing field accommodates and reduces vibrations within a laboratory. The experiments are extremely sensitive to vibrations. The floors in the laboratory have been isolated from the river, road and building to reduce vibrations to ensure accuracy of experiments. The proposed chiller is the only known solution with a proven track record at NRC, and will work in complete harmony with the pre-existing infrastructure to reduce vibrations to tolerable levels.
5. The requirement must be installed no later than March 31st 2016
Government Contracts Regulations Exception(s):
The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under Article 1016 d subsection 6(d). Only one person is capable of performing the work.
Additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services. (CAP Code 74)
Ownership of Intellectual Property: – No (IP) Intellectual Property is going to be generated with this requirement.
Period of the proposed contract or delivery date:
The product/system/equipment (as appropriate) must be delivered, installed and calibrated with the preexisting infrastructure no later than March 31st 2016.

Suppliers' right to submit a statement of capabilities:
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Closing date for a submission of a statement of capabilities February 22th 2016, 2PM Eastern Standard Time.
