Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

Definition of the requirement
The Department of Foreign Affairs, Trade and Development Canada (DFATD) has a requirement for the provision of uninterrupted legacy and digital television services for existing outlets located in the National Capital Region.
The requirement includes legacy and digital television service distribution to approximately 330 existing outlets with the capability to add or remove outlets on an “as and when requested” basis based on operational requirements.
Services must be distributed to each location using the existing coaxial or fiber distribution system. Due to government security restrictions, wireless signal distribution will not be allowed.
Services must also be distributed for the INFO60 and VIDEO61 internal broadcasting channels that are managed by the department.

Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
Requirements and Service type:
- Provide uninterrupted legacy and digital television services for existing outlets using existing infrastructure located in the National Capital Region.
- There can be no break in services to the department as this would be detrimental to the day-to-day operations and harmful to the departments’ ability to meet its commitments to regular business and mandate.
- Services must be distributed to each location using the existing coaxial or fiber distribution system. Due to government security restrictions, wireless signal distribution will not be allowed.
- Services must also be distributed for the INFO60 and VIDEO61 internal broadcasting channels that are managed by the department.
- Maintenance, cleaning and repair to Cable television hardware (e.g. replacement of remotes and or cable boxes’).
- Annual upgrade, when applicable of hardware and/or software to conform to the departments pre-existing infrastructure and developing standards over the course of the agreement.
- Services includes installation, relocation and servicing of hardware such as cable boxes’ and associated plugs, wiring and fixtures to various pre-defined areas
- Regular and Urgent Service Requests and the Contractor must confirm its availability to respond to regular requests within twelve (12) hours of notice from DFATD, and must respond within two (2) hours of written notice from DFATD for urgent requirements.
Support requirements:
- Single Point of contact to technical support, scheduling of any upgrades/remediation with 24/7 availability.
- Contractors` employees must be equipped to send and receive electronic communications (e.g. e-mail and text). The Contractor shall maintain communications via cellular phone with the departmental representative, assigned Project Officers and their supervisory staff during all installation, relocation and servicing at all locations of work. Cell phones must be provided to their employees at the Contractors’ expense.
Billing:
- Single monthly statements with detailed location-by-location billing identifying the quantity, model and serial numbers of box’s’ provided and/or service provided.

This procurement is subject to the following trade agreement(s):
- North American Free Trade Agreement (NAFTA)
- World Trade Organization - Agreement on Government Procurement (WTO-AGP)
5. Justification for the Pre-Identified Supplier
To ensure compatibility with existing infrastructure and equipment it is the intent of the department to contract with Rogers Communications Inc.
Rogers Communications Inc. has demonstrated capacity and ability to deliver these services to DFATD. Consideration was also given to the exceptional prohibitive costs to the Crown related to removal of existing infrastructure and the subsequent installation of new infrastructure. In addition, the potential break in services to the department would be detrimental to the day-to-day operations and harmful to the departments’ ability to meet its commitments to regular business and mandate.

The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection subsection 6(d) - "only one person is capable of performing the work").

The following exclusion(s) and/or limited tendering reasons are invoked under the:
- North American Free Trade Agreement (NAFTA) – Article 1016(2)(b) and Article 1016(2)(b)(d)
- World Trade Organization - Agreement on Government Procurement (WTO-AGP) - Article XIII(1)(b) and Article XIII(1)(d)
8. Period of the proposed contract or delivery date
The proposed contract is for a period of 5 years, from December 1st, 2019 to November 30th 2024.
9. Cost estimate of the proposed contract
The estimated value of the contract, including option(s), is $640,741.85 (GST/HST extra).

11. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

The closing date and time for accepting statements of capabilities is November 28th, 2019 at 2:00 p.m. EST.
