    Description

    The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for to renew the cable services contract in the RCMP Headquarters building in St. John’s, Newfoundland, to the pre-identified supplier. Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the posting period.

    If other potential suppliers submit a statement of capabilities during the posting period that meet the requirements set out in the ACAN, the government will may proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.

    If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will may be awarded to the pre-selected supplier.

    1. Definition of the requirement

    The Royal Canadian Mounted Police has a requirement for the provision of to renew the cable services contract in the RCMP Headquarters building in St. John’s, Newfoundland. The contract is to provide television service for 70 outlets throughout the building. The period of the contract is 5 years from date of award. All the infrastructure is in place and no new outlets will be added.

    1. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)

    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:

    • Experience

      10+ years in the cable tv industry

      ability to provide service through the existing structure cable installation in the building

    • Knowledge and understanding of cable tv, and the conversion from digital to analog for cable tv

    This procurement is subject to the following trade agreement(s):

    • Canadian Free Trade Agreement (CFTA)
    • North American Free Trade Agreement (NAFTA)
    1. Justification for the Pre-Identified Supplier

    The current cable services contract is with Rogers Cable Communications Inc. To ensure continuity of services and to prevent additional installation it is the intent of the RCMP to solicit a bid from Rogers Cable Communications Inc. A change of supplier would result in the procurement of already existing equipment.

    1. Government Contracts Regulations Exceptions

    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection GRC 6. (d) only one person or firm is capable of performing the contract.

    1. Exclusions and/or Limited Tendering Reasons

    The following exclusions) and/or limited tendering reasons are invoked:

    Canada Free Trade Agreement – CFTA Article 513 (c) for additional deliveries by the original supplier of goods or services that were not included in the initial procurement, if a change of supplier for such additional goods or services: (i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, software, services, or installations procured under the initial procurement; and (ii) would cause significant inconvenience or substantial duplication of costs for the procuring entity;

    • North American Free Trade Agreement (NAFTA) – Article 1016.2 (d) for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for exisiting supplies, services of installations , or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirement of interchangeability with already existing equipment or services.
    1. Period of the proposed contract or delivery date

    The proposed contract is for a period of 5 years, from date of award of contract to 60 months following the date of award inclusive.

    The estimated value of the contract, including option(s), is $101,976.00 (GST/HST extra).

    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
