Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Department of National Defence has a requirement for in-service support to ensure ongoing effectiveness, stability, integrity and ongoing suitability for aircrew training on the following simulators: - CP 140 Full Flight Simulator and Cockpit Procedures Trainers located in Greenwood, Nova Scotia; Comox, British Columbia; and eventually Winnipeg, Manitoba - CC130H Operational Flight Trainer located in Trenton, Ontario - CH146 Full Motion flight Simulator located in Gagetown, New Brunswick - CP140 Block 3 Operational Mission Simulator located in Greenwood, Nova Scotia and - CP140 Block 3 Procedures Crew Trainer located in Greenwood, Nova Scotia. As a result of continual improvements to the aircraft fleets, this support is required to ensure thatthe simulators remain fully mission capable and that commonality with the aircraft fleet is preserved. The support may include, but is not limited to, developing software changes to fix identified problems or snags; designing/manufacturing incidental parts to simulate the behaviour of real work aircraft components; or developing software and hardware instructions to interface real avionic parts with existing simulator hardware and hardware systems. 3. Criteria for assessment of the Statement of Capabilities As the simulator support will be integrated into the current simulator, it must be compatible and able to function within the existing simulator. Any interested supplier must demonstrate by way of a statement of capabilities that they have obtained an agreement form CAE Inc., Saint Laurent (Quebec), who has the Intellectual Property Rights to the existing hardware and software, to perform the support. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s): Agreement on Internal Trade (AIT) North American Free Trade Agreement (NAFTA) World Trade Organization Agreement on Government Procurement (WTO-AGP) 5. Justification for the Pre-Identified Supplier CAE Inc. holds the intellectual property rights to the existing simulators. Unless an agreement is obtained from CAE Inc. to use their background intellectual property, CAE Inc. is the only supplier capable of meeting the government’s requirement. For this reason, it is proposed to negotiate directly with the Original Equipment Manufacturer (OEM) and owner of the associated Intellectual Property (IP) rights, including existing simulator software and hardware design. 6. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) "only one person is capable of performing the work". 7. Limited Tendering Reasons The following limited tendering reasons are invoked under the: Agreement on Internal Trade (AIT) - Article - Article 506.12 (a) North American Free Trade Agreement (NAFTA) - Article 1016.2 (b) World Trade Organization Agreement on Government Procurement (WTO-AGP) - ArticleXV 1(b) 8. Ownership of Intellectual Property Ownership of any foreground Intellectual Property arising out of the proposed contract will vest in the Contractor. 9. Period of the proposed contract or delivery date The proposed contract is from contract award for a period of 3 years, plus 2 one-year options to extend the period of performance. 10. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is the 2nd August 2016 at 2:00 p.m. EDT. 13. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
