If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting officer will proceed to a full tendering process. 2. Definition of requirements and sole source justification The Department of Natural Resources Canada, Geological Survey of Canada Calgary, Alberta requires one (1) Carl Zeiss Axio Imager M2m Microscope System to augment the existing collection of Zeiss objective lenses which are specifically designed to work together with Carl Zeiss microscopes. The system will be used to study dispersed organic matter with heavy florescence applications and as such this is the only microscope that has the required fluorescence microscopy required to perform the technical requirements that Geological Survey of Canada Calgary requires. The following specifications of the Carl Zeiss Axio Imager M2m Microscope system are critical functionalities required by Geological Survey of Canada Calgary: - Completely automated and motorized for ease of use, speed, reproducible component settings, and for automated image acquisition. - Infinity Corrected System optics: This optical system has specific stray light trapping technology to decrease background and increase contrast of fluorescence images. - Integrated fluorescence-Beam path: Filter turret (manual or motorized) with 6 positions. Preconfigured with the following neutral variable density filters to reduce sample exposure to damaging light to increase preservation of the reactive organic matter during the fluorescence measurements. - Motorized filter turret switch times of minimum of 250ms. - Programmable focus drive speed to be stored for each objective, optimally tailored to all magnifications. - System must be able to be configured without an external PC and consequently be used as a genuine stand-alone system for portable and field applications. - Continuous, rectangular, luminous field diaphragm for homogeneous, bright illumination of the sample, which allows higher intensity of reflected light in both white and fluorescence mode and enable better image quality and measurement detection. - Accessible Infinity space in reflected and in transmitted light for the addition of other optical elements i.e. flexibility and expansion of addition of the modular systems. - Ergo-focus drive, coarse and fine (exchangeable right or left). - Triggerable 100W LED Illumination for brightfield, phase contrast, DIC imaging methods. 3. Trade Agreements Article 1016, Section 2, (b) of the North American Free Trade Agreement (NAFTA) "...where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;" Article 506, Section 12 (b) of the Agreement on Internal Trade (AIT) "...where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists;" 4. Government Contracts Regulations Exception This contract is subject to subsection 6 (d) of the Government Contracts Regulations, in that only one person or company is capable of performing the contract. 5.
