Advance Contract Award Notice An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the Requirement Natural Resources Canada (NRCan), CanmetENERGY, Devon, AB, has the requirement to supply 10 Concurrent -user Licenses, customize, install including data migration and train CanmetENERGY personnel on Sample Master® Laboratory Information Management Systems (LIMS) at their Devon, Alberta, Canada, facility. The requirement will include the customization of the new database to CanmetENERGY Specifications and the migration of data from the current database. The software must be provided by March 31, 2015, customizing, installed and training complete must be complete by March 31, 2016. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements: DELIVERABLES The following tasks are estimated to be required in order to meet CanmetENERGY requirements of the Sample Master® LIMS. SOFTWARE: Sample Master® Pro Sample Tracking Module Sample Master® Pro Data Entry Module Sample Master® Pro QA/QC module Sample Master® Pro Electronic Data Transfer module Sample Master® Pro Resource Management module Sample Master® Pro Maintenance module CUSTOMIZATION, INSTALLATION AND TRAINING: Tasks/Activities Deliverables/Milestones Requirements communicated ATL will communicate to CanmetENERGY the requirements for the server and database, as well as any other requirements for the IT infrastructure. CanmetENERGY will provide any required documentation (subject to privacy constraints) to ATL in order to create the tables, lists, etc., that will be used in the LIMS, based on NRCan current Sample Master configuration. System live for data entry The system will be in a state such that any sample and its results can be entered into the system and a simple report created. This requires client and project list, test list and test elements be implemented and all user accounts created. Four Instrument parsers operational Parsers will be created or deployed such that PIONA, SIMDIST, Gas Analysis and "Teather GC-MS" result files can be automatically entered into the LIMS. The data will be moved from the instrument via USB drive to separate computers and the parser must work on any computer with any user. One QA/QC chart created QC chart for CHN analysis created for all three elements to use as an example for other chart creation Custom reports created One general purpose report will be created to handle reporting of physical, elemental and distillation tests. A report for Gas Analysis will be created where results are normalized, and also normalized with air correction. One report combining PIONA, SOAP, and Teather GC-MS will be created. One report for SIMDIST will be created. Advanced Training received One day of training detailing the creation of custom reports, adding tests, clients and projects, creating invoices and control charts. 4. Applicability of the trade agreement(s) to the procurement This requirement is excluded from trade agreements based on the following: NAFTA Article 1016 - Limited Tendering Procedures 1016.2 (b) - where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. AIT Article 506 - Limited Tendering (Paragraph 12)(b) where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; CCFTA - Article Kbis-09: Tendering Procedures where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; CPFTA - Article 1409: Limited Tendering (b) where the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: (i) the requirement is for a work of art, (ii) the protection of patents, copyrights or other exclusive rights, or (iii) due to an absence of competition for technical reasons; Canada-Colombia FTA - Article 1409: Limited Tendering (b) where the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: (i) the requirement is for a work of art, (ii) the protection of patents, copyrights or other exclusive rights, or (iii) due to an absence of competition for technical reasons; 5. Contract Period Software Licence Delivery: March 31, 2016 Customization, Installation and Training: April 1, 2015 - March 31, 2016 7. Estimated Cost Software: $$43,543.80 CAD (plus applicable taxes) Customization, Installation and Training: $67,488.00 CAD plus applicable taxes) 8. Exception to the Government Contracts Regulations and applicable trade agreements Section 6 (d) of the Government Contract Regulations stating only one firm or individual is capable of performing the contract Sample Master ® LIMS software is the mandated enterprise solution for NRCan CanmetENERGY. This requirement is linked to specialized Lab application purchased through contract no. 23375-109196/001/EE issued by PWGSC through an open bidding process. Accelerated Technology Laboratories Inc., is the supplier of Sample Master® LIMS and consulting services. Accelerated Technology Laboratories Inc., is the only service organization certified to provide training and services. Accelerated Technology Laboratories Inc., is the only company that can sell Sample Master® LIMS licences and has exclusivity to the IP, copyright and source code for product and modifications. 9. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing Date for a Submission of a Statement of Capabilities The closing date and time for accepting statements of capabilities is March 4, 2015, at 2:00 p.m. MST. 12. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
