    This Advance Contract Award Notices cancels and supersedes previous bid solicitation number EP168-172747/C dated 2018-02-19 with a closing of 2018-04-06 at 14:00 Eastern Daylight Time (EDT). A debriefing or feedback session will be provided upon request to bidders/offerors/suppliers who bid on the previous solicitation.
    
    
    1. Advance Contract Award Notice (ACAN) 
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    2.  Definition of the requirement
    
    Public Works and Government Services Canada requires a Contractor to supply labour, supervision, tools, materials, and equipment necessary for a program of inspection, maintenance, and repairs of two generator sets and their transfer switches.
    
    The generator sets are located one at each at Timiskaming Dam and Big Chaudière Dam in northern Ontario.
    
    In all cases, the generator sets provide standby power for flow control equipment on the dams (i.e. stop log lifters, vertical lift gates). The generator set at Timiskaming also provides emergency power to the buildings at the dam site.
    
    3. Description of the equipment
    
    1- Timiskaming Dam
    
    The generator at Timiskaming Dam is a natural gas generator with an automatic transfer switch to be left set in automatic mode. The equipment was installed in 2012. 
    
    1.1 Generator

    1.3 Generator Ventilation Louvers
    Nailor louver-dampers, 2 units, Model #1606CDAF, 6-inch louvers, aluminum. Controlled by Belimo NFBUP damper controller.
    
    1.4 Electric Unit Heater
    In generator shed, thermostatically controlled by a wall-mounted thermostat. Dimplex Model EUH-B.
    
    
    2- Big Chaudière Dam
    
    The generator at Big Chaudière Dam is a diesel generator with an automatic transfer switch set in manual mode. The equipment was installed and commissioned in 2016. 
    
    2.1 Generator
    Generac SD50 Model #SDOO5OAG163.4D18HBNL3, Serial # 3000002089, 50kW, 50kVA, with the following key components:
    
    • Controller: Generac Quiet-Test™ H-100
    • Alternator: Generac Model 390, 208A, 120/240VAC, 1.0 PF, single phase
    • Engine: Diesel, Generac 4-cylinder, 3.4L
    • Engine heater: Coolant heater, 1500W, 120VAC
    • Fuel: Diesel, tank within generator base, capacity actual 65 gal., capacity useable 55 gal.
    
    2.2 Transfer Switch
    ASCO Series 300 Group G 3ATS, Model #D03ATSB20200FG0C Serial #1315134BR, 200A, 120/240V, LCD Control pane with microprocessor control.
    
    2.3 Suspended Unit Heaters
    Located in electrical building.
    
    4. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    
    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
    
    1. Suppliers must be authorized by the generator OEM to perform work on its equipment and have access to the OEM's technical support services and service bulletins.  
    
    Suppliers must provide letters from each OEM for the equipment listed above as proof of this.  The letter must confirm that the Supplier is an authorized service agent of the OEM or has a valid sub-contracting agreement with the OEM.  The letter must also confirm the Supplier has access to all parts, tools, materials, adjustment procedures, hardware, firmware, and software required in order to service and maintain the equipment listed above. 
    
    2. Suppliers must either have an oil condition monitoring predictive maintenance program or have the capability to sub-contract this portion to a qualified third party source.
    
    3. Suppliers must hold a valid clearance certificate from the Workplace Safety Insurance Board (WSIB)
    
    
    5. Applicability of the trade agreement(s) to the procurement
    
    The requirement is subject to the provisions of the World Trade Organization Agreement on Government Procurement (WTO-AGP), the North American Free Trade Agreement (NAFTA), the Canada-European Union Comprehensive Economic and Trade Agreement (CETA) and the Canadian Free Trade Agreement (CFTA).
    
    
    6. Justification for the Pre-Identified Supplier
    
    Total Power Limited is the exclusive representative for Generac Power Systems’ Industrial Product Line within the Canadian provinces of Ontario, Alberta and British Columbia.
    
    Generac offers equipment control panels with different levels of sophistication. Various control panels are proprietary to Generac's equipment and only their recognized Industrial Distributors are able to provide authorized service work.
    
    7. Exclusions and/or Limited Tendering Reasons 
    
    The following exclusion(s) and/or limited tendering reasons are invoked under the: 
    i. North American Free Trade Agreement (NAFTA) Article 1016: Limited Tendering Procedures;
    ii. Canada-European Union Comprehensive Economic and Trade Agreement (CETA) Article 19.12: Limited Tendering;
    iii. World Trade Organization Agreement on Government Procurement (WTO-AGP) Article XV: Limited Tendering;
    iv. Canadian Free Trade Agreement (CFTA) Article 513: Limited Tendering or Agreement on Internal Trade (AIT) Article 506: Procedures for Procurement, paragraphs 11 and 12.
    
    8. Period of the proposed contract or delivery date 
    
    The period of the contract(s) shall be for three (3) years with three (3) additional one-year option periods. The contract is intended to commence 01-07-2018.
    
    9. Cost estimate of the proposed contract 
    
    The estimated value of the contract, including option(s), is $400,000.00 to $700,000.00 (applicable taxes included).

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
