    Government of Canada is moving its Government Electronic

    An ACAN is a public notice indicating to the supplier community
    that a department or agency intends to award a contract for
    goods, services or construction to a pre-identified supplier,
    thereby allowing other suppliers to signal their interest in
    bidding, by submitting a statement of capabilities. If no
    supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date
    stated in the ACAN, the contracting officer may then proceed
    with the award to the pre-identified supplier.
    
    Public Works and Government Services Canada (PWGSC) intends to
    negociate a contract with the supplier Avensys for the
    procurement and delivery of a gas analyser model ServoPro 4100
    of Servomex to measure quantities of methane and carbon dioxide
    emissions inside respiratory chambers.   
    
    Quantity:  3 each 
    
    This item is to be delivered to Agriculture and Agri-Food Canada
    (Dairy and Swine Research Center) located in Sherbrooke, P.
    Quebec. 
    
    This procurement is subject to the following trade agreements:

    Justification of the Pre-selected supplier: 
    Avensys is the only Canadian distributer capable of meeting
    Agriculture and Agri-Food Canada's requirement due to logistical
    and compatibility reasons, where the introduction of a
    non-standard unit and /or manufacturer would cause operating
    difficulties, compatibility issues, maintenance problems and
    additional manipulation and handling costs.
    
    The following limited tendering reason is being invoked under
    the Agreement of Internal Trade: Article 506,  Section 12
    . to ensure compatibility with existing products, to recognize
    exclusive rights, such as exclusive licences, copyright and
    patent rights, or to maintain specialized products that must be
    maintained by the manufacturer or its representative;
    
    The following limited tendering reason is being invoked under
    the North American Free Trade Agreement (NAFTA) - Article 1016 ,
    Section 2(b)
    .  where, for works of art, or for reasons connected with the
    protection of patents, copyrights or other exclusive rights, or
    proprietary information or where there is an absence of
    competition for technical reasons, the goods or services can be
    supplied only by a particular supplier and no reasonable
    alternative or substitute exists; 
    
    No substitute justifications
    The research facilities of Agriculture and Agri-Food Canada
    (Dairy and Swine Research Centre, Sherbrooke, Quebec) are
    equipped with infrastructures to quantify methane (CH4) and
    carbon dioxide (CO2) emissions by dairy cows. These
    infrastructures are respiration chambers that allow the
    measurement of the amount of CH4 and CO2 daily emitted by cows
    placed inside the chambers. The concentrations of the gases are
    measured using gas analyzers (CH4 and CO2). For this purpose,
    they use infrared technology and therefore, the analyzers to
    purchase must use the same technology. The chambers are also
    equipped with a complex set-up of several instruments integrated
    and related to each other. The MODBUS protocol is used as a
    language to allow the communication among several instruments
    composing the set-up. This mode of communication is the basis to
    ensure safe , indispensable and reliable functions of the
    respiratory chambers. Therefore, any new instrument such as a
    new gas analyzer to be included in the set-up must use the same
    protocol of communication (i.e. MODBUS) in order to avoid
    corrupting the existing data acquired on the 'BUS' protocol.
    Based on these considerations, we identified the ServoPro 4100
    of SERVOMEX as the most appropriate analyzer to serve our needs
    without changing their original system.

    The maintenance, repair/service center is available in Canada
    through a local representative.       
    Technical support, spare parts and repair/service center from
    the manufacturer is offered in North America. 
    This type of after sales service avoids delays in our research
    work. 
    
    For all the above reasons, ServoPro 4100 from Servomex is the
    only known gas analyser that is capable of performing this
    requirement. 
    
    Delivery date:  7 to 9 weeks at receipt of order. 
    
    The purpose of this Advance Contract Award Notice (ACAN) is to
    signal the government's intention to award a contract for these

    If other potential suppliers submit a Statement of capabilities
    during the posting period that meet the requirements set out in
    the ACAN, the government will proceed to a full tendering
    process on either the government's electronic tendering service
    or through traditional means, in order to award the contract.

    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
    
    Documents may be submitted in either official language of Canada.
