    1. Advance Contract Award Notice (ACAN)
    An ACAN is a public notice indicating to the supplier community
    that a department or agency intends to award a contract for
    goods, services or construction to a pre-identified supplier,
    thereby allowing other suppliers to signal their interest in
    bidding, by submitting a statement of capabilities. If no
    supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date
    stated in the ACAN, the contracting officer may then proceed
    with the award to the pre-identified supplier. 
    
    2. Definition of the Requirement:
    The Department of Environment Canada (EC) regularly deploys
    Platform Transmitter Terminals (PTTs) on several avian species
    in order to monitor movements, habitat use, and activity
    patterns.EC has a requirement for the supply of 15, 30g solar
    powered GPS Platform Transmitter Terminals (PTT), neck collar
    configuration and 25, 30g solar powered GPS PTT, backpack
    configuration (North Star Model 30GPS, 30g GPS PTT) to
    Environment Canada, Saskatoon, SK by June 15, 2014. 
    
    3. Criteria for assessment of the Statement of Capabilities -
    Minimum Essential Requirements
    Any interested supplier must demonstrate by way of a statement
    of capabilities that it meets the following requirements:
    Be less than 65.00 grams in total weight (including all parts
    such as solar panels, antenna, reinforcements).  This does not
    include weight of neck collar.
    Height (profile) of unit (excluding antennae) must not exceed 16
    mm (0.62").
    Width of unit must not exceed 23 mm (0.87").
    Length of unit must not exceed 64 mm (2.5").
    Be externally mounted; some backpack mounted with Teflon tape,
    and some mounted on plastic neck collars sized for lesser snow
    geese (provided by EC).
    Have a permanently attached antennae that is:
    o	Robust to preening activities of geese, but flexible enough to
    withstand breakage.
    o	Be no longer than 197 mm (7.5") in addition to the unit
    length.  For the units mounted on neck collars, the antenna must
    be configured such that it does not inhibit activities such as
    preening and feeding.
    Be entirely rust-proof.
    Withstand extended and prolonged exposure to water, including
    salt water.
    Be able to store, via the internal GPS unit, multiple locations
    per day.
    Be able to upload stored (GPS locations) and current data via
    the Argos system at specified intervals.
    Operate in temperature ranges of -20 to 40 degrees Celsius.
    Be capable of running for multiple consecutive years without
    re-handling the bird. Batteries are to be recharged via solar
    panels mounted on the exterior of units, on top and side panels
    of the transmitter.  Expected operational life of units is 2-3
    years.
    Proof of unit testing or deployment on waterfowl species will be
    required in the statement of capabilities. Acceptable proof will
    include published studies or through references (name/contact
    information must be supplied).
    
    4. Applicability of the trade agreement to the procurement
    This procurement is subject to the following trade agreement: 
    Agreement on Internal Trade (AIT)
    North American Free Trade Agreement (NAFTA)
    
    5. Comprehensive Land Claims Agreement
    This procurement is subject to the Nunavut Land Claims Agreement.
    The final destination of the goods is in Nunavut (Karrak Lake
    and Perry River).
    
    6. Justification for the Pre-Identified Supplier
    North Star Science and Technology is the only supplier of solar
    powered, neck collar-mounted GPS PTT transmitters and the
    backpack-mounted and neck collar-mounted transmitters need to be
    identical for purposes of comparison with respect to size,
    weight, shape, longevity, accuracy and transmission to Argos.
    
    7. Government Contracts Regulations Exception:
    The following exception to the Government Contracts Regulations
    is invoked for this procurement under subsection 6 (d) - "only
    one person is capable of performing the contract"
    
    8. Exclusions and/or Limited Tendering Reasons
    The following exclusions and/or limited tendering reasons are
    invoked under the section of the trade agreements specified:

    12. 	Where only one supplier is able to meet the requirements of
    a procurement, an entity may use  procurement procedures that
    are different from those described in paragraphs 1 through 10 in
    the following circumstances:
    	(b)	where there is an absence of competition for technical
    reasons and the goods or 			services can be supplied only by a
    particular supplier and no alternative or 			substitute exists;

    2.	 An entity may use limited tendering procedures in the
    following circumstances and subject to the following conditions,
    as applicable: 
    	(b) where, for works of art, or for reasons connected with the
    protection of patents, 		copyrights or other exclusive rights,
    or proprietary information or where there is an 		absence of
    competition for technical reasons, the goods or services can be
    supplied       only by a particular supplier and no reasonable
    alternative or substitute exists;
     9.	The period of the proposed contract or the delivery date(s)
      The product must be delivered on June 15, 2014.
    
    10. Cost estimate of the proposed contract
    The estimated value of the contract is $150,040.00 (GST not
    included), $157,542.00(GST/HSTincluded).

    advertised requirements.

    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.

    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
