    1.Advance Contract Award Notice (ACAN)
    
    An ACAN is a public notice indicating to the supplier community
    that a department or agency intends to award a contract for
    goods, services or construction to a pre-identified supplier,
    thereby allowing other suppliers to signal their interest in
    bidding, by submitting a statement of capabilities. If no
    supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date
    stated in the ACAN, the contracting officer may then proceed
    with the award to the pre-identified supplier. 
    
    2.Definition of the requirement
    
    National Research Council Canada (NRCC) has a requirement for
    the supply and delivery of one (1) MTS 819 High Speed Test
    System to augment and integrate with the NRCCs existing MTS
    servo-hydraulic load frames ranging in capacity from 250 lbs to
    220 kips.
    
    The high speed load frame system consists of the high speed
    servo-hydraulic load frame unit (55 kips) with air isolation
    pads, hydraulic service manifold, FlexTest 60 Controller, a
    computer PC, system software including Echo Software and
    TestSuite Multipurpose Elite Software and an 11 kip A-frame
    style wedge action high rate grip set. Also included are system
    installation and commissioning service. 
    
    3.Criteria for assessment of the Statement of Capabilities
    (Minimum Essential Requirements)
    
    Any interested supplier must demonstrate by way of a statement
    of capabilities that its system meets the following requirements:
    
    -	Capacity: 55 kips servo-hydraulic actuator
    
    -	Speed: 36 ft/sec
    
    -	The high speed load frame system must be capable of operating
    in tension, compression and impact load scenarios.
    
    -	The high speed load frame system must be operable with NRCCs
    existing hydraulic oil distribution system which runs at 3000
    psi.
    
    -	The required high speed load frame system must be integrated
    with the existing MTS load frame hardware/software systems at
    the NRCC. The high speed load frame controller must be
    equivalent to the MTS FlexTest 60 Controller which is capable of
    additionally controlling an existing MTS load frame, for
    instance an MTS Model 880 100 kip load frame. The controller
    must also be expandable to include future control hardware to
    operate a third load frame. The control stations must be capable
    of operating each load frame independently from an electrical
    and hydraulic point of view. Therefore, the required load frame
    system can effectively upgrade the controller and control
    software of multiple existing servo-hydraulic load frames since
    they can be operated using the same package.
    
    -	The system must meet or exceed the data transfer speeds of the
    MTS system which has three separate data acquisition process
    rates 6 kHz (for control and basic data acquisition (DAQ)), 49
    kHz (intermediate DAQ rate for higher test speeds) and 5 MHz
    (highest DAQ rate for highest speeds). These rates can be
    controlled automatically based on the control configuration or
    selected manually in software. 
    
    -	Size envelope: The high speed test system must fit within a
    130 in. x 45 in. x 45 in. The actuator must be cross-head
    mounted to lower the working area for convenience.
    
    4.Applicability of the trade agreement(s) to the procurement
    
    This procurement is subject to the following trade agreement(s) :
    - Agreement on Internal Trade (AIT)
    - World Trade Organization - Agreement on Government Procurement
    (WTO-AGP)
    - North American Free Trade Agreement (NAFTA)
    
    5.Justification for the Pre-Identified Supplier
    
    MTS Systems Corporation is the manufacturer and the sole known
    distributor for the required system including both hardware and
    software. Both the hardware and software can and must be used
    interchangeably with NRCCs existing servo-hydraulic load frames.
    The MTS high speed load frame shares common controller and
    software platforms with NRCCs existing servo-hydraulic load
    frames. 
    
    Additional advantages include common fixturing and components
    which would be interchangeable with other existing MTS systems.
    NRCC also stocks a variety of spare parts for the existing MTS
    systems which are interchangeable among all MTS test frames.
    Purchasing the system from MTS would also minimize the time
    required to train staff who are already familiar with MTS
    control systems and software. 
    
    Furthermore, a non-MTS system would result in additional
    operating costs including: extensive staff training, maintenance
    of a unique system, unique software upgrades, and the
    requirement to stock spare parts which would not be common to
    SMPs existing load frames.
    
    6.Government Contracts Regulations Exception(s)
    
    The following exception(s) to the Government Contracts
    Regulations is (are) invoked for this procurement under
    subsection 6(d) - "only one person is capable of performing the
    work".
    
    7.Exclusions and/or Limited Tendering Reasons
    
    The following exclusion(s) and/or limited tendering reasons are
    invoked under the:
    
    - Agreement on Internal Trade (AIT)  Article 506.12 a) to ensure
    compatibility with existing products, to recognize exclusive
    rights, such as exclusive licences, copyright and patent rights,
    or to maintain specialized products that must be maintained by
    the manufacturer or its representative. 
    
    -World Trade Organization - Agreement on Government Procurement
    (WTO-AGP)  Article(s) XV d) for additional deliveries by the
    original supplier which are intended either as parts replacement
    for existing supplies, or installations, or as the extension of
    existing supplies, services, or installations where a change of
    supplier would compel the entity to procure equipment or
    services not meeting requirements of interchangeability with
    already existing equipment or services.
    
    -North American Free Trade Agreement (NAFTA)  Article(s)
    1016.2d) for additional deliveries by the original supplier that
    are intended either as replacement parts or continuing services
    for existing supplies, services or installations, or as the
    extension of existing supplies, services or installations, where
    a change of supplier would compel the entity to procure
    equipment or services not meeting requirements of
    interchangeability with already existing equipment or services,
    including software to the extent that the initial procurement of
    the software was covered by this Chapter.
    
    8. Delivery date
    
    The system must be delivered on or before November 30, 2014.

    Suppliers who consider themselves fully qualified and available

    described in the ACAN may submit a statement of capabilities in
    writing to the contact person identified in this notice on or
    before the closing date of this notice. The statement of
    capabilities must clearly demonstrate how the supplier meets the
    advertised requirements.
    
    11.Closing date for a submission of a statement of capabilities
    
    The closing date and time for accepting statements of
    capabilities is October 8, 2013 at 2:00pm EDT.

    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
    
    Documents may be submitted in either official language of Canada.
