If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2) DEFINITION OF THE REQUIREMENT The Marine Ecosystems and Aquaculture Division (MEAD) of Fisheries and Oceans Canada, Science Branch located in Nanaimo, British Columbia, Canada has a requirement for the supply and delivery of two (2) electronic fish measuring systems to expand the use of its integrated data acquisition system during fisheries research surveys. The only system identified as currently meeting DFO's operational requirements as detailed in this ACAN is the Scantrol FishMeter board Model FM-100USB (Qty: 2) with USB Cable FM-USBC (Qty: 4) and Magnetic Marker FM-MAP (Qty: 4). Atlantic Electronics Limited is the only distributor of the Scantrol FishMeter in Canada. 3) CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (MINIMUM ESSENTIAL REQUIREMENTS) Any interested supplier must demonstrate by way of a statement of capabilities that its system equipment offering meets the following minimum MANDATORY requirements: The system must: a) be delivered to Destination Nanaimo BC by no later than March 31, 2015; b) be waterproof to at least to the IP67 standard; c) be corrosion proof; d) be capable of directly measuring fish up to 1 meter long; e) have 5mm resolution or better; f) connect to a PC computer through a single USB cable for communication. The cable must be a total length of 2.5 to 3 meters from the board to the USB A male connector. The cable must be split with a waterproof (IP67) connector approximately 1 meter from the fish measuring board. There must be no additional junctions or splices in the cable; g) be poweredthrough the USB Cable; h) provide a programmable interface for custom application development; i) have the ability to function as not only a measurement device but also as a user input device, e.g. the board must be able to send not only the length but also commands. The commands must include but are not limited to: navigation (up, down, left, right, enter, delete); send numbers 0 to 9; and send male, female; j) have a response time (time elapsed between marking the length of the fish and the length data arriving at the PC computer) such that one (1) fish can be measured each second; k) be operated using a marker or stylus that is designed to be attached to the operator's hand and does not require a tether; l) have the ability to function as a simple measuring board in the event of electronic failure (e.g. have a one (1) meter measuring tape shown on the board so that in the the event that the electronic components of the board fail, fish can be measured manually). 4) APPLICABILITY OF THE TRADE AGREEMENTS TO THE PROCUREMENT This procurement is subject to the following trade agreements: - Agreement on Internal Trade (AIT) - North American Free Trade Agreement (NAFTA) 5) SET-ASIDE UNDER THE PROCUREMENT STRATEGY FOR ABORIGINAL BUSINESS Not Applicable 6) COMPREHENSIVE LAND CLAIM AGREEMENT(S) Not Applicable 7) JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER Atlantic Electronics Limited is the only known supplier who can supply and deliver a system that can meet the minimum essential requirements detailed under Paragraph 3. 8) GOVERNMENT CONTRACT REGULATIONS EXCEPTION(S) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) "only one person is capable of performing the work". 9) EXCLUSIONS AND/OR LIMITED TENDERING REASONS The following limited tendering reasons are invoked under the: - Agreement on Internal Trade (AIT) - Article 506.12(b) "where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists"; - North American Free Trade Agreement (NAFTA) - Article 1016.2(b) "where for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists"; and 10) PERIOD OF THE PROPOSED CONTRACT OR DELIVERY DATE All deliverables must be received at Destination in Nanaimo (British Columbia) Canada V9T 6N7 by no later than March 31, 2015 (MANDATORY). 11) COST ESTIMATE OF THE PROPOSED CONTRACT The estimated value of the contract is CAD $ 33,950.00, excluding Applicable Taxes, FOB Nanaimo BC Canada V9T 6N7, shipping charges, Canadian customs duties, and excise taxes included. 12) NAME AND ADDRESS OF THE PRE-IDENTIFIED SUPPLIER Atlantic Electronics Limited 1164 Topsail Road Mt Pearl, Newfoundland A1N 2Y2 13) SUPPLIER'S RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
