Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Department of Agriculture and Agri-Food Canada (AAFC) has a requirement for the supply of one (1) Quadrumat Junior Mill for wheat flour milling for Agriculture and Agri-Food Canada, Lethbridge Research Centre, Lethbridge, Alberta, Canada. The current wheat quality screening involves milling of wheat at advanced stages of wheat breeding. The milling information enables lines with desirable yield quality to advance and those with less desirable yields to be eliminated and unnecessary testing can be avoided. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its Product meets the following requirements: 1. The system being offered must be in current use in the market place for a minimum of two (2) years. 2. The system must be able to produce flour yield of 60-75% of standard bread flour particle size. 3. Must produce end product ash % values 0.5 -0.7% on dry basis 4. Minimum loss of moisture during milling (less than or equal to 1.5%) 5. The mill must have a hopper for grain addition and separate drawers for bran and flour collection. 6. The mill must be able to have fast and precise throughput of grain with adjustable feed rate of approximately 500g/5 minutes 7. The mill must have built in aspirator system 8. The mill must be laboratory scale bench top model, no larger than 36" x 44" x 36" (HxLxW) 9. Must have built in reel sifting system as close to 72GG screen 10. System to have self grinding effect 11. Mill must include 4 corrugated rolls specific for common bread wheat milling of the following sizes: for roll 1; 5 flutes/cm, for roll 2; 10 flutes/cm, for roll 3; 16 flutes/cm, and for roll 4; 18 flutes/cm. The gap between these rolls should be: between 1-2 (fixed), 2-3 (0.04 mm) and 3-4 (0.03 mm) 12. Must have quick and easy exchange of rollers and sifters 13. Rolls must be fixed to simulate commercial mills 14. Mill is to include corrugated rolls for grinding ranging from coarse to finer grinding 15. Mill must self clean before next sample is run 16. Electrical requirement: Must be 480 v; 16 amps; 60 hz. 17. Equipment must meet Canadian Standards Association (CSA). 18. Documentation /Technical Manuals. The Contractor shall provide a complete and current set of end-user documentation. Also must provide technical reference manuals from the Original Equipment Manufacturer (OEM). Manuals must be provided in English. Manuals also to be provided in French, if available. 19. All equipment shall be new, in that it shall not include refurbished equipment and that all equipment shall be of current manufacture. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) North American Free Trade Agreement (NAFTA) Canada - Chile Free Trade Agreement (CCFTA) Canada-Peru Free Trade Agreement (CPFTA) Canada-Columbia Free Trade Agreement 5. Justification for the Pre-Identified Supplier C.W. Brabender Instruments, Inc. New Jersey, USA is the only authorized distributor of Brabender Instruments in Canada. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is invoked for this procurement: 6 (d) only one person is capable of performing the work. 7. Exclusions and/or Limited Tendering Reasons The following exclusions and/or limited tendering reasons are invoked under the Agreement on Internal Trade, Article 506-12(a) To ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licenses, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacture or its representative. (b) Where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists. North American Free Trade Agreement 1016.2(b) where, for works of art or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; Canada - Chile Free Trade Agreement, Article Kbis-09 (b) where, for the works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reason, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; Canada - Peru Free Trade Agreement, Article 1409,1(b) where the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: (i) the requirement is for a work of art, (ii) the protection of patents, copyrights or other exclusive rights, or (iii) due to an absence of competition for technical reasons; Canada-Columbia Free Trade Agreement, Article 1409,1(b) where the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: (i) the requirement is for a work of art, (ii) the protection of patents, copyrights or other exclusive rights, or (iii) due to an absence of competition for technical reasons; 8. Delivery date The product must be received on or before March 31, 2015. 9. Cost estimate of the proposed contract The estimated value of the contract, is $31,500.00 (GST/HSTextra). 10. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is December 11, 2014 at 2:00p.m. CST. 13. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
