INTRODUCTION Public Works and Government Services Canada (PWGSC), on behalf of the Department of National Defence, intends to solicit a proposal and negotiate a contract with Resodyn Acoustic Mixers in Butte, Montana for the supply of a Resonant Acoustic Mixing System. Included in the requirement will be an option to purchase additional unit and optional goods and services. 2. REQUIREMENT Requirement is for an acoustic mixer that does not use impellors or agitators in the mixer to achieve a uniform mix of materials. The mixer must be capable of mixing solids, liquids, and/or gases using a uniform shear field generated by an acoustic standing wave, in order to minimize frictional heating and localized shear heating. The mixer will be used to mix small-scale (454 grams or less) mixes of materials including energetic material mixtures, and will collect data on mixing and environmental conditions during mixing. 4. MANDATORY PERFORMANCE SPECIFICATIONS Any interested supplier must demonstrate by way of a statement of capabilities that its system meets the following mandatory requirements: 1. Capacity: Mixer capacity must be no less than 454 grams (approximately equivalent to 1 lb or 16 oz, or 0.473 liter in volume) and no more than 908 grams (approximately equivalent to 2 lb or 32 oz, or 0.946 liter in volume). 2. Viscosity: Viscosity: Mixer must be capable of mixing a minimum of 0.3 cP (acetone) mixtures of powders, liquids, gases, or combinations. 3. Agitation: Agitation must be accomplished using vibration below the ultrasonic range in order to maximize the mixing scale, without the use of agitators or impellors in the chamber. 4. Mixing of hazardous materials: The mixer must be able to mix hazardous / explosive materials, providing isolation of the mixture from the environment during mixing (i.e. sealed containers) 5. Environmental condition: The mixer must be explosion proof, capable of being operated remotely. 6. Temperature control: The mixing container must have the capability to be temperature controlled. 7. Dust Control: Mixer must have provisions for dust control, using sealed or sealable containers. 8. Mixing containers: Must have provision for interchangeable mixing containers. System must come complete with varying sizes of mixing bowls from 8 and 16 oz vessels (237 ml to 473 ml). System must also have the capability utilizing 118 ml (test tube size) to 473 ml (4 to 16 oz). 9. Pressure: Mixer must be capable of mixing materials in a vacuum environment. 10. Operating system and software: The system must have the capability for the loading of pre-calculated mixing regimes to ensure quality control, data collection, and validation and refinement of pre-calculated mixing regimes to improve the quality of the samples generated 5. SOLE SOURCE JUSTIFICATION Resodyn Acoustic Mixers is the only suppler with the technology of acoustic resonance (by patents) and the technical expertise to manufacture and sell mixers with acoustic resonance technology. There are no alternate sources of supply due to the proprietary rights held by ResoDyn. 6. TRADE AGREEMENTS The requirement is subject to the provisions of the North American Free Trade Agreement (NAFTA), and the Agreement on Internal Trade (AIT). Government Contract Regulations: 6.(d) only one person or firm is capable of performing the contract. AIT Article 506. 12 Where only one supplier is able to meet the requirements of a procurement, an entity may use procurement procedures that are different from those described in paragraphs 1 through 10 in the following circumstances: (b) where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; NAFTA Article 1016: Limited Tendering Procedures. 2. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions, as applicable: (b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; 7. ESTIMATED COST Estimated value of the requirement: $175,000.00 CND (GST not included). Included in the estimated cost is the price of an additional unit (if exercised) and optional items over the next two fiscal years. The Crown retains the right to negotiate with suppliers on any procurement. 10. SUPPLIERS RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the Contracting Officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the Contracting Authority. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. Documents may be submitted in either official language of Canada.
