ADVANCE CONTRACT AWARD NOTICE (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. REQUIREMENT The Government of Canada has a requirement to establish a Standing Offer for the supply and delivery of Teledyne RD Instruments (RDI) Acoustic Doppler Current Profiler (ADCP) oceanographic instruments, equipment parts and accessories to maintain operational capability and support the existing inventory of Teledyne RDI ADCP units. Canada intends to establish this Standing Offer for this scientific equipment with Dasco Equipment Inc, based on the understanding that they are the exclusive Canadian Distributor for Teledyne Marine equipment. The period of the Standing Offer is for 5 years. 3. CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (minimum essential requirements) Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: a. Supplier is a Teledyne Marine Certified Parts and Service provider for Canada. Supplier must provide a letter or certificate from the manufacturer, Teleydne Marine, indicating that the supplier is an authorized parts and service provider for Canada. b. Supplier has direct access to Teledyne equipment warranty processes as indicated in the letter or certificate. c. Supplier has access to all manufacture technical notices for Teledyne RDI ADCP equipment as supported by Teledyne Marine. d. Has access to Teledyne warranties and warranty and maintenance services as supported by Teledyne Marine. 4. JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER The DASCO Equipment Inc. is the exclusive manufacturer’s representative of Teledyne Marine products in Canada. 6. EXCLUSIONS AND/OR LIMITED TENDERING REASONS The following exclusions and limited tendering reasons are invoked under the: Section 6(d) of the Government Contracting Regulations Article 513.1(b)(ii) of the Canada Free Trade Agreement Article XV.1 (b) of the World Trade Agreement, Agreement on Government Procurement Article 19.12 of the Canada-European Union Comprehensive Economic and Trade Agreement 7. PERIOD OF THE PROPOSED CONTRACT OR DELIVERY DATE The Standing Offer will be for a 5 year period, ending on March 31, 2027. 8. COST ESTIMATE OF THE PROPOSED CONTRACT The estimated usage of the Standing Offer is $7,000,000.00 (Applicable Taxes included) for entire 5 year period. 9. SUPPLIERS’ RIGHT OT SUBMIT A STATEMENT OF CAPABILITIES Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. CLOSING DATE FOR A SUBMISSION OF A STATEMENT OF CAPBILITIES The closing date and time for accepting statement of capabilities is April 8, 2022. 12. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
