    Description
    Trade Agreement: NAFTA/AIT/Canada FTAs with Peru/Colombia/Panama
    Tendering Procedures: All interested suppliers may submit a bid

    Nature of Requirements: 
    
    To enter into contracts for the Canada School of Public Service to have 
    
    access to the Contractor’s content library so that the School can 
    select commercial off the shelf self-paced e-learning and/or 
    video-based learning content to purchase/acquirethe rights to access.  
    
    
    Canada intends to award up to two contracts. The period of the each contract is from April 01, 2016 to March 31, 2018.  The Contractor grants to Canada the irrevocable option to extend the term of the Contract by up to three(3) additional one (1) year period(s) under the same conditions. 
    
    The requirement is subject to the provisions of the World Trade Organization Agreement on Government Procurement (WTO-AGP), the North American Free Trade Agreement (NAFTA), and the Agreement on Internal Trade (AIT).
    
    The Federal Contractors Program (FCP) for employment equity applies to this procurement; see Part 5 - Certifications, Part 6 - Resulting Contract Clauses and the annex titled Federal Contractors Program for Employment Equity - Certification.
    
    To be declared responsive, a bid must:
     
    a. comply with all the requirements of the bid solicitation;
    b. meet all mandatory technical evaluation criteria; and
    c. obtain the required minimum of 70% (R1 through R4) overall of the points for the technical evaluation criteria which are subject to point rating.
    
    Th
    e rating is performed on a scale of 450 points (R1 through R4) and 480 points total.
    
    Bids not meeting (a) or (b) or (c) will be declared non-responsive. Neitherthe responsive bid that receives the highest number of points nor the one that proposed the lowest price will necessarily be acce
    pted.
    
    The lowest price per point will be determined as follows: 
    Price per Point = Total Evaluated Price (Including Option 
    Periods)/Total Points Achieved.
    
    The responsive bids will be ranked in ascending order of evaluated prices per point; the responsive bid with the lowest evaluated price pe
    r point being ranked first (Primary Contractor).  Of the highest ranked 
    
    responsive bids in ascending order of evaluated prices per point, up to 
    
    two (2) bidders will be recommended for award of a contract.
    
    In the event two or more responsive bids have the same lowest evaluated 
    
    price per point, these bids will beranked in descending order of the overall scores obtained for all the technical evaluationcriteria su
    bject to point rating detailed in Part 4; the responsive bid obtaining 
    the highest overall score being ranked the highest.
    
    In order to protect the integrity of the procurement process, bidders are advised that Canada may reject abid in the following circumstances: 
    
    
    a. if the Bidder, any of its subcontractors, any of their respective employees or former employees was involved in any manner inthe preparation of the bid solicitation or in any situation of conflict of interest or appearance of conflict of interest;
    
    b. if the Bidder, any of its subcontractors, any of their respective employees or former employees had access to information related to the bid solicitation that was not available to other bidders and that would, i
    n Canada's opinion, give or appear to give the Bidder an unfair advantage.
    
    The experience acquired by a bidder who is providing or has provided 
    the goods and services described in the bid solicitation (or similar goods or services) will not,in itself,be considered by Canada as conferring an unfair advantage or creating a conflict of interest. This bidd
    er remains however subject to the criteria established above.
    
    Where Canada intends to reject a bid under this section, the 
    Contracting Authority will inform the Bidder and provide the Bidder an opportunity to make representations before making a final decision. Bidders who are in doubt about a particular situation should contact the 
    
    
    Contracting Authority before bid closing. By submitting a bid, the Bidder represents that it does not consider itself to be in conflict of in
    terest nor to have an unfair advantage. The Bidder acknowledges that it 
    iswithin Canada's sole discretion to determine whether a conflict of interest,unfair advantage or an appearance of conflict of interest or unfair advantage exists.
