Notice of Intent to Award a Contract
Notice is hereby given that the City of Abbotsford (the “City”) is contemplating making a direct award of a contract to Stantec Consulting Ltd. (the “Service Provider”) for additional work for the following:
The City issued a Notice of Intent to Direct Award – NOI No.: 1220-2023-2963 – Engineering Services for Barrowtown Pump Station Flood Protection Wall on July 26, 2023; closed unchallenged. The value of the contract was $629,864.25 plus applicable taxes.
Background
The November 2021 extreme weather event has caused flooding in various parts of the City, and most notably the widespread flooding in the Sumas Prairie, due to the Nooksack River overflow from Whatcom County in the United States of America.
Stantec had originally been asked to design a 6.0m elevation floodwall. However, the City has changed the direction for Stantec to provide design options and cost analysis for three floodwall heights: 4.0m, 5.0m, and 6.0m. Stantec has previously allow scope for two floodwall option, this change adds one additional option to the scope of work for the preliminary analysis.
Scope of Services
The scope of work in this change order includes additional geotechnical and structural analysis required to develop the options and additional time spent on the preliminary design report.
Rationale for Contemplating a Direct Award
The City is contemplating a direct award with the Supplier for the following reasons:
The value of the additional work is $70,135.75 and that the total value of the contract is expected not to exceed $700,000.00 CAD plus applicable taxes.
Submission of Objection Notice
Any Respondents that still wish to object to this decision they should email their objection to the attention of Sailesh Kapadia, Buyer III, Procurement Services at https://abbotsford.bidsandtenders.ca by December 4, 2023, no later than 2:00 p.m. local time.
Submissions by other methods will not be accepted.
Respondents objecting must outline specific reasons for their objection in their email as well as demonstrate their ability to perform the contemplated work and/or services and show availability and resources. The Respondent’s ability to provide goods and services of the same or better quality and price and within the required period will be the key criteria used in the consideration of any Respondent’s objections.

Rationale for Contemplating a Direct Award
The City is contemplating a direct award with the Supplier for the following reasons:
- Due to the unpredictability of severe weather events, it is important that this project be expedited to enable the construction of the flood protection wall before the 2024-2025 high-risk flood season. With the objectives of public security and safety and the protection of human, animal and plant life and health, and given the extent of the preliminary investigation and design work require to construct this wall.
The value of the additional work is $70,135.75 and that the total value of the contract is expected not to exceed $700,000.00 CAD plus applicable taxes.
