- Advance Contract Award Notice (ACAN) - An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement- The National Research Council Canada has a requirement for an Exterior Paint job of a Bell 412HP Airframe. The contractor will be responsible to perform the following tasks:
Task 1: Removal and reinstallation of doors, cowls and access panels
Task 2: Removal and reinstallation of Airframe from Landing Gear
Task 3: Complete strip and paint (4 colors)
Task 4: Replacement of airframe seals
Task 5: Minor sheet metal repairs and body work
Task 6: Replace unserviceable latches
Task 7: Reweigh aircraft and calculate new weight and balance
Task 8: Aircraft painted using Glasurit 22 line of paint.
Task 9: Transport Canada Certified
Task 10: Return ground transportation of the aircraft from its current location to the contractor’s facility at the contractor’s expense.

4. Justification for the Pre-Identified Supplier - Eagle Copters was pre-selected for this requirement as they are an exclusive Bell (OEM) approved Repair and Maintenance facility in Canada. Eagle Copters is a long-time Bell aircraft solutions provider where Eagle technicians/engineers are (OEM) trained and certified. Eagle copter complies with (OEM) specifications and Transport Canada regulations. Eagle has been working with the National Research Council since 2013 on a number of modifications and upgrades to NRC’s Bell 412 helicopter. The helicopter is presently located at the supplier’s facility in pieces (grounded) because of engineering complexities with these upgrades. As the aircraft is grounded due to engineering complexities normal flight is not possible. In terms of costs and schedule, Eagle does not have to pay ground service transportation as the aircraft is already at the contractor’s facility. The schedule and logistical efforts by the contractor are significantly reduced and improved to meet a project completion date of February 28th 2017.
5. The following exclusion(s) and/or limited tendering reasons are invoked under
1016 (b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
1016 (d) for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services, including software to the extent that the initial procurement of the software.
6. Ownership of Intellectual Property
There is no IP considerations with this procurement. Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
7. Period of the proposed contract or delivery date: (Estimated start date:) February 15th 2017 and be (Estimated completion date) by February 28th 2017.
Cost estimate of the proposed contract: $75,000 - $150,000 (Taxes extra)

9. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
