1. The Purpose and Explanation of an ACAN
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of Requirement
The Department of Foreign Affairs, Trade and Development (DFATD) has a requirement for the installation, programming, testing of 25 X-ray machines and relevant training required. The work will involve the following:
- Contractor to provide certified installers/technicians to perform pre-identified, site specific installation, programming and testing for all 5030si Smiths Detection parcel x-Ray machines as per GAC.
- Contractor must have ability and capacity to travel to various Canadian Embassies world-wide to perform the work.
- Contractor is to provide comprehensive training to all relevant mission security managers and operators that will incorporate both operational and safety considerations pertaining to the Smiths 5030si X-Ray machine.
- Contractor to provide all personnel, tools, supervision, transportation to and from site, materials, field testing equipment and site management.
3. Criteria for assessment of the Statement of Capabilities provided
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
- Contractor must be qualified and certified by Smith Detection Inc. to perform all tasks indicated within this requirement, on the X-Ray machine model – Smiths-Detection 5030si
- Can provide all services listed in 2. Definition of the requirement

The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work.”
The identified provider in section 13 below is the only one able to meet all of the criteria identified in paragraph 3 above.

9. Justification for the pre-identified supplier
We intend to deal directly with the supplier mentioned in section 13 below as, it is the only known supplier that can meets the mandatory criteria set out in section 3 above.
Should Canada receive a statement of capabilities from a supplier that contains sufficient information to indicate that it meets the requirements set forth in this ACAN, a competitive process will be triggered with a technical and financial evaluation methodology of the bids proposed by the potential bidders
10. Period of the Proposed Contract
The proposed contract is for a period of 6 months, from December 2018 to June 2019.
11. Estimated Value of the Proposed Contract
The total estimated value of the contract is $ 254,250.00 CDN including all expenses, such as applicable taxes, travel and living, option periods.
12. Closing Date and Time
The Closing Date and Time for accepting Statements of Capabilities is December 22th, 2018 at 2:00pm EST.

14. Rights of Suppliers
Suppliers who consider themselves fully qualified and available to provide the services or goods described in this ACAN may submit a Statement of Capabilities demonstrating how they meet the advertised requirement. This Statement of Capabilities must be provided via e-mail only to the contact person identified in Section 15 of the Notice on, or before, the closing date and time of the Notice. If the Bidder can clearly demonstrate they possess the required capabilities, the requirement will be opened to electronic or traditional bidding processes.
