Description
The Canadian Food Inspection Agency (CFIA) has a requirement for the provision of essential support services and an annual preventative maintenance for its equipment in the Burnaby Laboratory. The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for these services to Biomérieux, 7815 Henri Bourrassa West, St-Laurent, Québec, H4A 1P7, Canada. Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the 15 calendar day posting period.
If other potential suppliers submit a statement of capabilities during the 15 calendar day posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the pre-selected supplier.
Background
The CFIA’s Burnaby Laboratory conducts diagnostic analysis of food pathogens samples using the Biomérieux VIDAS, VITEK C, and easyMag systems. There are currently VIDAS, VITEK C, and easy Mag instruments at the Burnaby laboratory that require essential support services and an annual preventative maintenance.
The proposed contract is for a period of one (1) year with an irrevocable option on the part of Canada to extend the period by up to four (4) one-year periods.
CFIA reserves the right to exercise options non-consecutively and is under no obligation to exercise any option. Optional services are included in the resulting contract for the provision of the same services, essential support services and an annual preventative maintenance, to the same OEM equipment in other CFIA Laboratories across Canada.
The estimated value of the contract, including the option periods, is up to $92,377.10 (excluding applicable taxes). The optional services will be an additional value to the resulting contract.
Minimum Essential Requirements
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
- Provide a resource that is certified and authorized to provide support services and preventative maintenance for our Biomerieux VIDAS, VITEK C and easyMag systems;
- Provide OEM certified replacement parts (new parts only) and consumables according to the defined maintenance procedures;
- Provide manufacturer recommended annual preventive maintenance scheduled by appointment including travel, labour, prescribed parts and quality assurance documentation;
- Provide an support services;
- Provides on-demand repairs e including travel, labour and parts;
- Provide telephone and remote electronic support during business hours;
- Provide ongoing update to instruments’ software and resolve machine notifications, as needed.
- Provide updates and notifications intended to improve the instruments’ performance;
- Must be able to provide support services, preventative maintenance, and repairs to the same OEM equipment in other CFIA laboratories across Canada.
Justification for the Pre-Selected Supplier
Biomérieux is the only known supplier that can provide the services that meets the minimum essential requirements.
The following exception to the Government Contracts Regulations is invoked for this procurement under Part 1 subsection 6(d) - "only one person is capable of performing the work".
Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
Submission of Statement of Capabilities
Suppliers who consider themselves fully qualified and available to meet the specified requirements may submit a statement of capabilities, in writing, to the Contracting Authority identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The closing date and time for accepting statements of capabilities is July 24, 2019 at 2pm Eastern Standard Time.
