    Advance Contract Award Notice – ACAN - (20-58007)

    Repair the 5500M multiplex generator of the Yxlon 225-VF x-ray

    Advance Contract Award Notice (ACAN):

    • An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

    Background:

    • National Research Council of Canada - Aluminium Technologies Center (ATC), Saguenay site, has a requirement for the provision of the services of a contractor to repair its 5500M multiplex generator of 225-VF Yxlon X-ray analysis equipment.

    Definition of the Requirement: 

    • The National Research Council Canada - Aluminium Technologies Center (ATC), Saguenay site, has a requirement to repair the 5500M multiplex generator of the Yxlon 225-VF x-ray analysis equipment in order to meet its requirements for several projects in the Automotive and Surface Transportation Program.
    • The work will involve the following: 
      • Replacement parts must be new and of the new generation and completely compatible with the equipment.
      • Must Install and demonstrate that the device is fully functional (Calibration included)
      • Must provide documents attesting to the warranty period for parts and services
      • The electrical diagrams must be provided if the connection of the replaced parts is not identical to the original parts.
      • The CSA certification must be provided.

     Statement of Capabilities (Minimum Essential Requirements):

    • By submitting a statement of capabilities, any interested parties must adhere to the following minimum essential requirements:
    • Must have extensive knowledge, understanding and proven experience with the Yxlon X-Ray System 550M 225-VF
    • Professional designation, accreditation, and/or certification: Must be an accredited supplier of the original equipment manufacturer COMET AG.

      Sole Source - Provisions in accordance with the Government Contracts Regulations (GCRs)

    • Only one firm is capable of performing the contract

      Applicability of the trade agreement(s) to the procurement

      This Procurement is subject to the following trade agreement(s)

      Limited Tendering Provisions in accordance with the trade agreements:

    • Applicable Exceptions to Soliciting Bids under the Government Contracts Regulations (GCRs) (Section 6):
      • 6.(d) only one person or firm is capable of performing the contract.
    • Limited Tendering Provisions in accordance with the Trade Agreements
      • For works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.

    Justification for the Pre-Identified Supplier:

    • QNDE is an authorized supplier/distributor of COMET AG, INDUSTRIAL X-RAY, who owns all the intellectual property of existing and new equipment, and allows the installation and maintenance of this equipment only to exclusive accredited suppliers in each of the regions served by them.

    Ownership of Intellectual Property (IP):

    • IP will not be generated during the course of this contract.

    Period of the proposed contract or delivery date

    • Delivery of the device, ~14 weeks, including
    • work on site in the estimated period of September 7 to 11, 2020 or earlier (Estimated start and completion date).
    • The National Research Council Canada reserves the right to negotiate follow-on phases/requests of similar complexity and value as required on an optional three (3) years period (10/9/2020 au 9/9/2023).

    Cost estimate of the proposed contract

    • The estimated value of the contract is $120,000.00 (GST and PST extra).

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
