Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement To enter into Contract with L-3 Communications MAS (Canada) Inc., Mirabel, Quebec for the Repair and Overhaul (R&O), Technical Investigation and Engineering Support (TIES), Special Investigations and Technical Studies (SITS), Mobile Repair Parties (MRP) , Publication Management Services (PMS), Structural Integrity Program (ASIP) for the CT114 Tutor. Work to be performed at the Contractor's facilities, at the Contractor's selected Sub-Contractor's facilities, and/or by Contractor's working at Department of National Defence (DND) or other facilites specified by the Technical Authority (TA) Contractor's shall have the Intellectual property or have agreements in place for use of such Intellectual Property to accomplish the required work at no additional cost to the Crown. 3. Applicability of the trade agreement(s) to the procurement As this is a service contract on the behalf of the Department of National Defence under Federal Stock Class 16, it is exempt from the North American Free Trade Agreement (NAFTA) in accordance with NAFTA Chapter 10, Annex 1001.1b-1 Section A para 2 and Annex 1001.1b-2, Section B General Note 1; and from the World Trade Organization Agreement on Government Procurement (WTO-AGP) in accordance with WTO-AGP Annex 1 and 4, note 4. The Agreement on Internal Trade applies and the limited tendering strategy as per Article 506.12(a) applies (to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licenses, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative). 4. Justification for the Pre-Identified Supplier You are hereby notified that it is the intention of Public Works and Government Services Canada (PWGSC) to negotiate a sole source contract for this requirement with L-3 Communications MAS (Canada) Inc., Mirabel, Quebec Canada as they are the only known company capable of performing the work due to exclusive rights. 5. Period of the proposed contract or delivery date Contract period: 1 April 2014 to 31 March 2016 with two irrevocable one-year option periods to 31 March 2018. 6. Cost estimate of the proposed contract The estimated cost of the proposed contract including the option period is $13,337,100.00 HSTI. 7. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 9. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is 15 January, 2014, at 2:00 p.m. EST. 10. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
