    1.	Purpose of an Advance Contract Notice (ACAN)
    		
    An Advance Contract Award Notice (ACAN) allows department and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a goods, service or construction contract to a
    pre-identified supplier.  If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting officer will proceed to a full
    tendering process.
    
    2.	Definition of requirements and sole source justification
    
    NRCan, Devon, Alberta has a requirement for the supply and
    delivery of a 568-T-FMD-SS-VS.25-30''/300
    PSI-GE-RTC-4848-MCM-PSM-SVM-ASME-Modified Stirred reactor
    system, 600 ml, T316 stainless steel and a QW10091AA Cylinder.
    NRCan will be conducting a number of experiments in parallel
    using a pressure vessel system with a quartz viewing window.
    NRCan is requiring an identical system to the pressure vessel
    reactor system with a quartz window they have purchased in the
    past (see minimum essential requirements below). The system must
    have a single long quartz viewing window in a tall narrow 600 ml
    stirred, temperature controlled pressure vessel to be able to
    observe the reaction interfaces at all levels of the vessel. 
    
    2.1 Minimum Essential Requirements
    
    Any interested supplier must demonstrate by way of a statement
    of capabilities that its product meets the following
    specifications:
    
    The Stirred Reactor System must:
    
    Be a 600 ml volume capacity, with a 9  inches tall reactor body
    The window must be a 6 inch long by 1 inch wide quartz single
    viewing window (cannot be multiple smaller windows, NRCan must
    be able to see the entire vertical profile)
    Be temperature controlled to a minimum of 80C
    Be stirred controlled cariable rpm, minimum 1850 rpm
    Be pressure rated to a minimum of 700 psi
    
    3.	Trade Agreements
    
    	Article 1016, Section 2, (b) of the North American Free Trade
    Agreement (NAFTA)

    protection of patents, copyrights or other exclusive rights, or
    proprietary information or where there is an absence of
    competition for technical reasons, the goods or services can be
    supplied only by a particular supplier and no reasonable
    alternative or substitute exists;"

    4.	Government Contracts Regulations Exception
    
    This contract is subject to subsection 6 (d) of the Government
    Contracts Regulations, in that only one person or company is
    capable of performing the contract.

    8.	Submission of Statement of Capabilities by Suppliers
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice.  The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officers name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement. Documents may be submitted in either official
    language of Canada.
