Advance Contract Award Notice An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or co nstruction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a st atement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the Requirement Agriculture and Agri-Food Canada, located in Lacombe, Alberta has a requirement for the supply, delivery, installation, off-loading, and training of one (1) TA. HDPlus Texture Analyzer. Agriculture and Agri-Food Canada is seeking a TA. HDPlus Texture Analyzer for measuring force and distance under both compression and tension conditions in raw and cooked meat. The results are used in analyses including date from the current system ( TA.XTPlus). The technology used in the two machines must be fully comparable with past, current, a nd future projects. All components must be 100% compatible with the TA.XTPlus as well as the Exponent Software. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 1) Results must be 100% comparable to TA.XTPlus. The TA.HDPlus Analyzer is able to measure force and distance under both compression and tension conditions in raw and cooked meat. These results are used in analyses including data from our current system (TA.XTPlus). The technology used in these two machines must be fully comparable with past, current and future projects. 2) All components must be 100% compatible with the TA.XTPlus. 3) Must be 100% compatible with Exponent Software. Customized macros have been developed within this software to satisfy the requirement of our specific research programs. Current timelines for research projects cannot acc ommodate delays to modify the processes at the lab. 4) Must have the ability to accommodate 100Kg load cell. We need the analyzer to be able to handle the 100kg load cells. 5) Texture Analyzer must meet the following maximum footprint: a. Max. height 1.0 meter; b. Max. width 0.6 m; c. Max. depth 0.5 m; and d. Max. weight 40 Kg. 4. Applicability of the trade agreement(s) to the procurement The procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The proposed instrument accommodates 100Kg load cell, and is produces results fully comparable with past, current and future projects. The instrument must contain loading cells, blades, and other parts interchangeable with those from the TA.XTPlus system. The instrument must not exceed a footprint of the following dimensions : Max. height 1.0 meter; Max. width 0.6 m; Max. depth 0.5 m; Max. weight 40 Kg. The pre-identified supplier is the only supplier that we are aware of who offers a product which meets all the Minimum Essential Requirements listed abo ve in point number 3. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d) - only one person is capable of performing the contract. 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: Agreement on Internal Trade (AIT) - Article 506.12 (b)"Where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particularsupplier and no alternative or substitute exists." North American Free Trade Agreement (NAFTA) - Article 1016 2 (b) "w here, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists." 8. Delivery Date All the deliverables are required on or before March 31, 2016. 9. Cost Estimate of the Proposed Contract The estimated value of the contract, including option(s), is $32,588.41 CAD (GST/HST extra). 10. Suppliers’ Right to Submit a Statement of Capabilities: Suppliers who consider themselves fully qualified and available to provide the services and/or goods described herein, may submit astatement of capabilities in writing to the contact person identified in t his notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing Date for a Submission of a Statement of Capabilities The closing date and time for accepting statements of capabilities is January 04 2016 at 2:00 p.m. MST. 13. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
