Trade Agreement: NAFTA/AIT/Canada FTAs with Peru/Colombia/Panama Tendering Procedures: Generally only one firm has been invited to bid Attachment: None Non-Competitive Procurement Strategy: Exclusive Rights Comprehensive Land Claim Agreement: Yes Vendor Name and Address: Atco Structures & Logistics Services Ltd Suite 203, 5109 - 48 Street Yellowknife Northwest Territories Canada X1A1N5 Nature of Requirements: Vehicle Rentals, Resolute Bay, Nunavut Purpose of an Advance Contract Notice (ACAN) An Advance Contract Award Notice (ACAN) allows department and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a goods, service or construction contract to a pre-identified supplier. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting officer will proceed to a full tendering process. 2. Definition of requirements and sole source justification In support of Op NUNALIVUT 14, Department of National Defence (DND) will require four (4) rental vehicles while operating in the vicinity of RESOLUTE BAY, NU during April 2014. The Contractor must supply the following rental vehicles in RESOLUTE BAY, NU from 2 to 30 April 2014 inclusive: three (3) Crew Cab Pick-ups in good condition, cleaned, mechanically checked and inspected prior to pickup at 0900 on 2 April 2014 until return on 30 April 2014; and one (1) 7 Passenger Van in good condition, cleaned, mechanically checked and inspected prior to pickup at 0900 on 2 April 2014 until return on 30 April 2014; The Contractor will be responsible for maintaining all vehicles from normal wear and tear, including replacing all worn tires prior to the start of the contract and whenever necessary throughout. If necessary, the Contractor will be responsible for towing the vehicle from the point of vehicle breakdown to the contractor's repair facility. The Contractor must pick-up unserviceable vehicles within 12 hrs and deliver repaired vehicles within the following 12 hrs. In case the vehicle cannot be repaired within these time lines, the contractor shall provide another vehicle as a replacement. The vehicle must meet the original standards and be of the same size and category or better. Should the replacement vehicle require repairs, the Contractor must provide a new vehicle within 24 hours. The Contractor will not bill DND for any replacement vehicles provided to DND. All vehicles must be winterized for severe weather, including fitting with block heaters, battery blankets and all other required modifications for safe and efficient operation. Snow brushes and block heater plugs must be included as part of this winterization. The Contractor must ensure that all vehicles meet Transport Canada and Nunavut safety guidelines for motor vehicles. 3. Trade Agreements Article 1016, Section 2, (b) of the North American Free Trade Agreement (NAFTA) "...where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;" Article 506, Section 12 (b) of the Agreement on Internal Trade (AIT) "...where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists;" 4. Government Contracts Regulations Exception This contract is subject to subsection 6 (d) of the Government Contracts Regulations, in that only one person or company is capable of performing the contract. 5. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
