    ADVANCED CONTRACT AWARD NOTICE (ACAN)
    SOFTWARE PORTAL DISTRIBUTION / P2P PROTOCOL & LICENSING
    APPLICATION
    
    1.	Advance Contract Award Notice (ACAN)
    
    An ACAN is a public notice indicating to the supplier community
    that a department or agency intends to award a contract for
    goods, services or construction to a pre-identified supplier,
    thereby allowing other suppliers to signal their interest in
    bidding, by submitting a statement of capabilities. If no
    supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date
    stated in the ACAN, the contracting officer may then proceed
    with the award to the pre-identified supplier.
    
    
    2.	Definition of the requirement
    
    EC (EC) has a requirement for a commercial off-the-shelf (COTS)
    solution that includes the software application, maintenance and
    support services, and professional services. The application is
    required as an add-on to the System Center 2012 Configuration
    Manager infrastructure for the distribution of security patches,
    images, software deployment, license auditing and license
    optimization, all within a peer to peer protocol environment
    permitting the use of workstations over servers, reducing cost
    and complexity.
    EC is seeking to achieve a reduction in hardware costs and an
    improvement in existing software distribution capabilities to
    remote sites using the standard System Center 2012 Configuration
    Manager functionality. A COTS application is required within the
    EC production environment to enable EC to identify current
    software usage and to begin reclaiming unused software licenses
    on their desktops to achieve tangible cost savings. EC has a
    requirement to improve performance across the System Center 2012
    Configuration Manager infrastructure while reducing costs at the
    same time. As part of the requirement, bandwidth throttling, to
    remove the competition between IT and business traffic, with
    peer-to-peer delivery eliminates servers and complexity from the
    network.
    EC requires a self-service portal for software distribution to
    the clients, software approbation technology, license management
    & software license recycling in order to streamline the license
    management and software approval process, which allows for
    reclaiming of software licenses avoiding future new costs,
    decentralization of Distribution Points via peer-to-peer
    technology equating to a reduction/reliance of servers in line
    with Government of Canada initiatives, and Power management to
    enable control of workstations to enable off hour maintenance
    and greening. The software and services are required in English
    only.
    The requirement is for the procurement of an application suite
    with a one-year maintenance period with options to extend the
    maintenance and support services for five additional one year
    terms, and to acquire professional services and training, as and
    when required, to support the implementation of the software.
    
    
    3.	Criteria for assessment of the Statement of Capabilities
    (Minimum Essential Requirements)
    
    Any interested supplier must demonstrate by way of a statement
    of capabilities that its solution meets the following
    requirements:
    
    Technical Requirements
    
    1.	The solution must integrate into a multi Windows domain
    environment, spanning numerous subnets and more than 70 physical
    sites with over 7000 users and 10,000 computers.
    2.	The solution must integrate with System Center 2012
    Configuration Manager.
    3.	The solution must provide software license management which
    includes license reporting, license reconciliation and automatic
    license reclaiming.
    4.	The solution must provide a peer-to-peer distribution
    mechanism to deliver local (localized in the same subnet) System
    Center 2012 Configuration Manager content (Operating System
    deployment, software deployment, Software update deployment)
    without resorting to a local site server or local distribution
    point.
    5.	The solution must provide the ability to deploy OSD
    (Operating System Deployment) to bare metal machine using local
    (localized in the same subnet) System Center 2012 Configuration
    Manager content without resorting to a site server or
    distribution point.
    6.	The solution must provide wake up on LAN of computers located
    on different subnets without requiring modification to existing
    router configuration, using local site servers or dedicated
    local workstations
    7.	The solution must provide a self-serve software portal that
    streamlines and automates client software requests.
    
    
    4.	Security Requirements
    
    There is no security requirement associated to this procurement.
    
    5.	Applicability of the trade agreements to the procurement
    
    This procurement is subject to the following trade agreements:

    Ÿ	North American Free Trade Agreement (NAFTA)
    Ÿ	World Trade Organization - Agreement on Government Procurement

    6.	Justification for the Pre-Identified Supplier
    
    1E Limited is the only known supplier of a software portal
    distribution/peer to peer protocol and licensing application
    that meets all of the requirements listed in Section 3, above. 
    
    
    7.	Government Contracts Regulations Exception
    
    The following exception to the Government Contracts Regulations
    is invoked for this procurement under subsection 6(d) - "only
    one person is capable of performing the work".
    
    
    8.	Exclusions and/or Limited Tendering Reasons
    
    The following exclusions and/or limited tendering reasons are
    invoked under the section of the trade agreements specified:
    
    Ÿ	Agreement on Internal Trade (AIT) - Article 506 paragraph 12
    (b) "where there is an absence of competition for technical
    reasons and the goods or services can be supplied only by a
    particular supplier and no alternative or substitute exists"
    
    Ÿ	North American Free Trade Agreement (NAFTA) - Article
    1016.2(b) "where, for works of art, or for reasons connected
    with the protection of patents, copyrights or other exclusive
    rights, or proprietary information or where there is an absence
    of competition for technical reasons, the goods or services can
    be supplied only by a particular supplier and no reasonable
    alternative or substitute exists"
    
    Ÿ	World Trade Organization - Agreement on Government Procurement
    (WTO-AGP) - Article XV 1.(b) "when, for works of art or for
    reasons connected with protection of exclusive rights, such as
    patents or copyrights, or in the absence of competition for
    technical reasons, the products or services can be supplied only
    by a particular supplier and no reasonable alternative or
    substitute exists"
    
    
    9.	Ownership of Intellectual Property
    
    Ownership of any Foreground Intellectual Property arising out of
    the proposed contract will vest in the Contractor.
    
    
    10.	Period of the Proposed Contract and Deliverables
    
    The proposed Contract is for a period of 1 year from date of
    Contract Award. 
    
    The proposed Contract includes options to extend the contract
    period for up to an additional five one-year periods.
    
    The Contractor will be required to deliver a Desktop software
    portal distribution/peer to peer protocol and licensing
    application meeting all of the requirements listed in Section 3
    above, including associated Maintenance and Support Services,
    Professional Services, and Training.
    
    
    11.	Cost estimate of the proposed contract
    The estimated value of the contract, including option(s), is
    $949,038.73 (HST included).

    to provide the goods, services or construction services
    described in the ACAN may submit a statement of capabilities in
    writing to the contact person identified in this notice on or
    before the closing date of this notice. The statement of
    capabilities must clearly demonstrate how the supplier meets the
    advertised requirements.
    
    
    14.	Closing date for a submission of a statement of capabilities
    
    The closing date and time for accepting statements of
    capabilities is December 16, 2014 at 2:00pm, EST.

    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
    
    Documents may be submitted in either official language of Canada.
