An Advanced Contract Award Notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of requirement DRDC Atlantic has a requirement for a software library and associated application for realistic simulation of launch and recovery of small craft from ships. The software library must be able to simulate the following components of a launch and recovery system: Winch, including modelling of drum inertia and braking friction, Boom crane, including modelling of control system, motions, and loads, Towing cable, including modelling of motions, tension, torsion, and collisions with other objects, Payload, including modelling of motions, hydrodynamic forces, and collisions with other objects. Simplified model of cable handling by deck personnel using a simple winch model at a fixed location on a ship. Furthermore, the contract will develop a simulation of the following: A naval frigate launching and recovering a small vessel using a crane and two deck personnel at a fixed location on the ship. 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its services meets the the requirements that are detailed herein. 4. Justification for the Pre-Identified Supplier DRDC Atlantic has a requirement for a software library and associated applications for realistic simulation of launch and recovery of small craft from ships. The simulation must model collisions between bodies, including collisions between cables and other bodies. The simulation must also model the influence of deck personnel applying tension to cables connected to the small craft being launched and recovered. The simulation will be based on the Simulation of Ship Mechanical Systems library developed for DRDC Atlantic by the proposed contractor under contracts W7707-098195/001/HAL and W7707-115188/001/HAL. Due to the detailed knowledge of the software library, it is proposed that Dynamic Systems Analysis of Victoria, British Columbia be awarded the contract to develop the launch and recovery simulation. 5. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 6. Ownership of Intellectual Property Canada intends to retain ownership of any Foreground Intellectual Property arising out of the proposed contract, under the following Exceptions: (6.4.2) the main purpose of the contract, or of the deliverables contracted for, is to augment an existing body of Canada's background information as a prerequisite to the transfer of the augmented background to the private sector, through licensing or assignment of ownership (not necessarily to the original contractor), for the purposes of commercial exploitation; (6.4.3) the main purpose of the contract, or of the deliverables contracted for, is to deliver a component or subsystem that will be incorporated into a complete system at a later date, as a prerequisite to the planned transfer of the complete system to the private sector, through licensing or assignment of ownership, for purposes of commercial exploitation; 7. The period of the proposed contract The proposed contract is from the date of contract award, to February 28, 2013. 8. A cost estimate of the proposed contract The estimated value of the contract, including options(if applicable), is $60,000.00 (GST/HST extra). 9. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. The closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is August 27, 2012 at 2:00 P.M. ADT. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
