1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
Parks Canada, Peterborough Ontario, has a requirement for the supply of 12 Keller Digilevel EC SDI-12 Water Level Pressure Transducers.
Due to the large number of currently operated automated gauges in real-time over a large geographic area (i.e. hourly data measurements and daily automated pulls) that are required for everyday operation decisions in the Trent-Severn Waterway (Southern Ontario) there is a necessity to accurately record water levels with the most robust, easy to install and low maintenance sensors. Sensors which provide true values of water levels instantaneously without requiring any additional data or sensors are important for data quality in the daily water management operations.
3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements:
• 16-bit internal digital error correction for cost-effective low Total Error Band, which includes the combined effects of non-linearity,hysteresis and non-repeatability as well as thermal dependencies over the compensated temperature range (Standard 0.1% accuracy)
• Multi-stage lightning protection
• 316L SS flush diaphragm construction ensures longevity in hostile environments
• SDI-12 Communication Interface for compatibility with SDI-12 data loggers and telemetry
• Isolated sensor reference connection ac¬commodates Ø 3/8 inch O.D. tubing
• Graphical user interface for enhanced setup and communication
- Intuitive device connection and setup utility
- Live reading mode facilitates on-site setup
- Emulate modes for Tavis transducers which are currently used across Trent-Severn Waterway and Rideau Canal systems, Design Analysis, and KPSI® Series 500 SDI-12 transmitters, Pressure Systems/Esterline

5. Justification for the Pre-Identified Supplier
Technel Engineering is the only official distributor of Digilevel EC SDI-12 Level Transmitter by Keller America in Canada with no alternatives due to the following reasons:
The 12 Keller Digilevel EC SDI-12 pressure transducer is the only option currently available with a detachable cable and detachable vent tube. This allows for the possibility of a direct swap of the senor should it break or require calibration. The Digilevel EC SDI-12 is the only water level pressure transducer that has 2 ports: one for communication and one for the vent tubing.
The Keller Digilevel EC SDI-12 transducer comes in a vented style which does not require an additional sensor to account for the variation in barometric pressure. Such a feature allows the Keller Digilevel EC SDI-12 transducer to provide true values of water levels instantaneously. The large vent tube diameter does not require desiccant which would decrease theamount of maintenance.
Keller Digilevel EC SDI-12 transducer is the only transducer on the market that has a vent tube not encased in the communication cable. Therefore it does not require a custom vent tube cable and allows for unlimited installation options.
The sensor is extremely tolerant to storage and deployment in cold weather; it has been successfully deployed in Arctic conditions which are much more severe than those experienced in Southern Ontario.
The sensor is known for its robustness and the Tavis version has been deployed for over 20 years at some locations on the Trent Severn Waterway.
6. Government Contracts Regulations Exception(s)
The following exception(s) to the Government Contracts Regulations is (are) invokedfor this procurement under subsection 6(d) only one person or firm is cable of performing the contract.
7. Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are invoked under the
Agreementon Internal Trade (AIT) - Article(s) 506 (b) - where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; and
North American Free Trade Agreement (NAFTA) - Article(s) 1016.2 (b) - where for works of are, or for reason connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
8. Period of the proposed contract or delivery date
The product must be delivered on June 06, 2016.
9. Cost estimate of the proposed contract
The estimated value of the contract, including option(s), is $54,840.00 x (HST extra).

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
