    Nature of Requirements: 
    
    1. Advance Contract Award Notice (ACAN) 
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    2. Definition of the requirement
    The National Research Council Canada (NRCC) in Boucherville requires a spheronization/hybridization system in a laboratory format. The NARA NHS-0system or a proposed system with equivalent performance and dimensions, must fit within a space that is 1 m of maximum depth, 1.75 m of maximum length and maximal height of 1 m. Installation on a table or within the depth of a laboratory counter is mandatory. The NARA system or an equivalent system must permit preparation of spherical natural graphite for Li-Ion battery anode. The proposed system must also include spray nozzles in the transformation chamber to dispense liquid solutions of polymer-solvent. The system will also be used for rounding natural graphite flake and decorating the surface of the later with lithium alloys nanoparticles. This type of hybridisation capabilities is unique to the NHS-0 from NARA and is well establish as unique in itsown kind. According to our research, only the NHS-0 system from NARA has the required characteristics and capacity to meet the criteria listed at section #3 of this notice and our operational requirements 
    
    3. Criteria for assessment of the Statementof Capabilities (Minimum Essential Requirements)
    a) The equipment will operate optimally with quantities of feed material as low as 500 g
    b) The equipment must supply at least 20g/batch.
    c) The equipment will be installed on a counter top or table having dimensions of: MAX depth = 1 m; MAX length = 1.75 m and MAX height = 1 m
    d) In one single step, the equipment must be capable of transforming natural graphite made of free flowing flakes to a free flowing dry powder of natural graphite made of spherical shaped particles. 
    e) The spherical shape of the natural graphite must be due to graphene plane bending and not edge erosion of the flakes
    f) The shape modification process will take place in an enclosure keeping dust particles from flying out
    g)The system must offer the possibility to choose between an inert gas or air in the enclosure’s atmosphere
    h)  The flow rate or pressure inside the enclosure will be adjusted using a gage
    i)  The equipment will allow solvents to be sprayed on the material inside the enclosure while the transformation process in ongoing.

    7. Justification for the Pre-Identified Supplier 
    The supplier must provide equipment that meets all criteria mentioned at section #3 of this present notice.  To PWGSCs knowledge, only NARA Machinery CO., LTD has the available equipment capable of meeting those criteria.
    
    8. Government ContractsRegulations Exception(s) 
    The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 
    
    9. Exclusions and/or Limited Tendering Reasons
    The following exclusion(s) and/or limited tendering reasons are invoked under the
    
    o Agreement on Internal Trade (AIT)  Article 506 par. 12b)
    *where there is an absence of competition for technical reasons and the goods or services can be supplied onlyby a particular supplier and no alternative or substitute exists;
    
    o North American Free Trade Agreement(NAFTA)  Article 1016 par. 2b)
    * where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusiverights,or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;

    12. Cost estimate of the proposed contract 
    The estimated value of the contract, including option(s), is between $ 100,000.00 and $200,000.00 (GST/HST extra).

    14. Suppliers' right to submit a statement of capabilities 
    Suppliers who consider themselves fully qualified and available to provide the goods and services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    15. Closing date for a submission of a statement of capabilities 
    The closing date and time for accepting statements of capabilities is November 24th 2016 at 2:00 p.m.(EST)

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
    
    Documents may be submitted in either official language of Canada.
