Nature of Requirements:
1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
The Longueuil Health Canada Microbiology Laboratory offers analytical services to several branch programs. The laboratory possesses an integrated system for the preparation of culture media. The automated preparation of microbiological culture media system consists of a media sterilizer, a Petri dish dispenser and a printer enabling the production of the majority of the culture media required by various programs.
Health Canada requires a Petri dish dispenser system (with the option to purchase, in the future, carousels of varying types) to replace the current system which is at the end of its useful life. This system must be compatible with the two other instruments already in place and not replaced (Automated media preparator Masterclave AESAP 1080 and printer Linx 4900), and must allow, using accessories, to use different sizes of Petri dishes and tubes, refrigerating them after filling in order to initiate the gelling process more rapidly and to avoid spilling of culture media by a frictionless mechanism.
3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier mustdemonstrate by way of a statement of capabilities that its system meets the following requirements:
Mandatory Technical Specifications
The delivered system must have the following specifications:
• The distributor system must have the ability to adapt to different brands (e.g. Fisherbrand, VWR, Gosselin, etc.), different types of petri dishes (as minimum: polystyrene, slippable lid) and different sizes of petri dishes (as minimum: 90x15mm, 100X15mm, 150X15mm, 150X25mm, 47mm) and tube sizes (asminimum: 13, 16 and 20mm in diameter)
• The distributor system with all its components and accessories must fit within a maximum space of 28''(width) x 29'' (depth) x 60'' (height)
• The distributor system must allow the carousels to be pre-loaded with petri dishes before installing onto the system’s base
• The system’s carousel handle must be on the exterior side for ergonomic handling.
• The distributor system must be fitted with a microprocessor control allowing the capacity of storage for up to 99 unique programs
• The distributor system must be grupper free and have a frictionless transfer of the plate into the filling area
• The distributor system must be equipped with a 2.3W UV light or higher
• The distributor system must have apump back function
• The distributor system must have adjustable carousel and rotor speeds
• The distributor system must be compatible with the existing equipment:
- Linx 4900 printer
- Automated media preparator, Masterclave AESAP 1080
• Service must be delivered within 24 hours of the service call

7. Justification for the Pre-Identified Supplier
The supplier must be able to provide a system that complies with all of the criteria mentioned at point 3 of this notice. To PWGSC’S knowledge, the Media Fill system from Systec GmBH is the only system that meets or exceeds all of the mandatory technical specifications, and Innovation Diagnostics Inc. is the only authorized distributor of Systec GmBH in Canada.
8. Government Contracts Regulations Exception(s)
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".
9. Exclusions and/or Limited Tendering Reasons

The system (with installation, qualification and training) must be delivered as soon as possible.
Optional goods must be delivered within the agreed upon timeframe at time of exercising the option.
12. Cost estimate of the proposed contract
The estimated value ofthe contract, including option(s), is between 50,000.00$ and 60,000.00$ (GST/HST extra).

14. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
15. Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of capabilities is February 3, 2017 at 2:00 p.m. EST.

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
