    Nature of Requirements: 
    An ACAN is a public notice indicating to the supplier community
    that a department or agency intends to award a contract for
    goods, services or construction to a pre-identified supplier,
    thereby allowing other suppliers to signal their interest in
    bidding, by submitting a statement of capabilities. If no
    supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date
    stated in the ACAN, the contracting officer may then proceed
    with the award to the pre-identified supplier. 
    Canada Border Services Agency (CBSA) has a requirement for a
    license to provide web access to Info-directTM for up to 35
    concurrent users to query the National Canadian Telephone
    Directory Database which contains approximately 90-95%+ of all
    published Business and Residential telephone listings in Canada.
    The data is to be used to query cargo consignee information to
    identify and assess risk at Canadian Ports of Entry. The license
    provides a secure internet database application for individual
    record look-up and verification which allows users to search
    listings by:
    •          name; 
    •          address, full or partial;
    •          phone number;  
    •          postal code; 
    •          a combination of any of these input options, moving
    from 1 search function to another; and  
    •          reverse lookup on any field.
    It allows a number of user-friendly display options and timely
    provision of counts (within 10 seconds). 
    The database is updated on a monthly basis and includes detail
    drawn from all major telephone companies and their directory
    publishers across Canada and must include at a minimum:

    Any interested supplier must demonstrate they could meet the
    following requirements:
    ·	Unlimited web access to a secure internet database application
    for individual record lookup 	and verification for up to 35
    concurrent users to 90-95%+ of all current published Business
    	and Residential telephone listings in Canada from the Telephone
    Company, Directory 	Publisher, Data Supplier and Geographic Area
    listed in Table #1 including at a minimum of 11.1 million
    residential listing and 1.7 million business listings;
    · 	Requires the provider of the database to have in place by
    Oct. 1, 2014 a direct relationship 	with Canadian
    Telecommunication Companies that includes data legally obtained
    from the Telecommunication Companies via an electronic feed
    (demonstrated with Letters of exclusive authorization from the
    Telecommunication Companies listed in the table above.)
    ·	Allows users to search listings by:
    		•          name; 
    		•          address, full or partial;
    •          apartment number;
    		•          phone number;  
    		•          postal code; 
    	•          a combination of these input options, moving from 1
    search function to another; 			and  
    		•          reverse lookup on any field;
    ·	Allows a number of user-friendly display options and timely
    provision of counts (within 10 		seconds); 
    ·	Provides an alternative spelling function that allows a user
    to try different choices of the way, place, or person names have
    been spelt and it allows users to refine their search to a
    particular city or town;
    ·	Includes a feature allowing users to set their preferred
    language (English or French) with all 		information thereafter
    be available in the language of their choice;
    
    	· 	Data that is updated on a monthly basis; and 
    ·	Provides access to a database that has been available and
    supported at minimum of 3 years in the last 5 years to at least
    3 separated corporate clients;
     
    This procurement is subject to the following trade agreement:
    Agreement on Internal Trade (AIT)
    The Info-direct database is the only  product that can provide
    90-95%+ of all current published Business and Residential
    telephone listings in Canada from the Telephone Company,
    Directory Publisher, Data Supplier and Geographic Area listed in
    Table #1.
    Failure to have access to the data would significantly hinder
    CBSA Targeting Officers in conducting their risk assessments. It
    is not feasible to invest in another product that does not
    provide all of the data found in the current database and to
    train all of the staff on a new product. Failure to contract for
    the proposed procurement would create an unnecessary disruption
    to current operation activities that would have a negative
    impact on CBSA and Canadian business operations.
    Section 6 (d) of the Government Contract Regulations is being
    invoked in this procurement as only one person is capable of
    performing the contract. 
    Articles 506.12 (a) and 506.12 (b) of AIT are applicable on the
    basis of limited tendering due to compatibility with existing
    products, to recognize exclusive rights, such as exclusive
    licenses, copyright and patent rights, or to maintain
    specialized products that must be maintained by the manufacturer
    or its representative, and where there is an absence of
    competition for be supplied only by a particular supplier and no
    alternative or substitute exists, respectively.
    Ownership of any Foreground Intellectual Property arising out of
    the proposed contract will vest in the Contractor.
    The conditions of the developer's shrink-wrap license,
    click-through license and/or other license agreement are not
    acceptable to the Crown.  The information product is
    proprietary, and the proposed Contractor must have the authority
    to negotiate the terms and conditions of the contract and the
    related information product licensing terms including, but not
    limited to; limitation of liability, indemnification,
    transferability of license, termination/refund to the Crown.
    
    The proposed contract is from April 1, 2015 up to and including
    March 31, 2016 with option to extend up to four (4) annual
    periods. 
    The cost estimate is $63,000.00 for a one year license with four
    (4) additional option years for a total estimated cost of
    $315,000.00 notincluding all applicable taxes.

    Suppliers who consider themselves fully qualified and available
    to provide the goods, services or construction services
    described in the ACAN may submit a statement of capabilities in
    writing to the contact person identified in this notice on or
    before the closing date of this notice. The statement of
    capabilities must clearly demonstrate how the supplier meets the
    advertised requirements.
