    1. Advance Contract Award Notice (ACAN) 
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    
    2. Definition of the requirement 
    
    - JUS must provide a comprehensive research collection of Canadian Law and a limited research collection of international law with special emphasis in several areas, as determined by the priorities of the Department, to meet its research needs. The titles and quantities required represent legal information research resources that are essential to support Justice Canada’s ongoing business requirements. This information is used to support legal research for legal advice, policy development, legislation and litigation for the Government of Canada.
    
    - The Department of Justice (JUS) has a requirement for the supply of current releases, versions, editions, etc. of serial publications - including but not limited to annuals, supplemented loose-leaf books, electronic loose-leaf publications, newsletters, digests, law reports, and journals, as published by Carswell, a division of Thomson Reuters Canada Ltd (hereafter referred to as Carswell) in print or electronic format, to a variety of JUS library locations across Canada. The specific titles, publishing format (print or electronic) and number of copies of each publication ordered by JUS may change throughout the contract period. All titles ordered can be found in Carswell’s catalogue or in the catalogues of the companies from whom Carswell is acting as the distributor.
    
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    
    Any interested supplier must demonstrate by way of a statement of capabilities that its products meet the following requirements:
    
    - Ability to supply current releases, versions, editions, etc. of serial publications - including but not limited to the following formats:
    1. Annuals;
    2. Supplemented loose-leaf books;
    3. Electronic loose-leaf publications;
    4. Newsletters;
    5. Digests, 
    6. Law reports; and
    7. Journals.
    
    - Ability to supply the following mandatory legal titles in either print or electronic format:
    1. Annotated Immigration and Refugee Protection Act of Canada
    2. Annotated Aboriginal Law: The Constitution, Legislation, Treaties and Supreme Court of Canada Case Summaries
    3. British Columbia Annual Practice
    4. Constitutional Law of Canada (Hogg)
    5. Federal Courts Practice
    6. Stikeman Income Tax Act Annotated
    7. Loi du practicien: loi de l’impôt sur le revenu
    8. Martin’s Annual Criminal Code
    9. Ontario Annual Practice
    10. Watson & McGowan’s Ontario Civil Practice
    11. Practitioner’s Goods and Services Tax Annotated with Harmonized Sales Tax
    12. Practitioner’s Income Tax Act
    13. Tax Court Practice
    
    - Ability to supply additional titles and quantities, as published by Carswell, on an as and when requested basis and in either print or electronic format, to JUS employees.
    
    - All supplied materials must contain identical content and intellectual property to that which is published by Carswell. This material must be made available for purchase at the time of publishing or distribution by Carswell. All of the titles required by JUS for which Carswell is the copyright owner or under exclusive license from the copyright owner must be supplied. 
    
    
    4. Applicability of the trade agreement to the procurement 
    
    This procurement is subject to the following trade agreement:
    
    - Canadian Free Trade Agreement (CFTA)
    
    
    5. Justification for the Pre-Identified Supplier 
    
    This collection is the only known information product that can meet all of the above mandatory requirements. Carswell is the publisher of the required information product and is the only vendor that can satisfy the requirement for the reason of exclusive and proprietary rights.
    
    
    6. Government Contracts Regulations Exception 
    
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection:
    
    6(d) - "only one person is capable of performing the work".
    
    
    7. Exclusions and/or Limited Tendering Reasons 
    
    The following exclusion and/or limited tendering reasons are invoked under the:
     
    - Canadian Free Trade Agreement (CFTA) - Article 513, paragraph (b), section ii)
    
    
    8. Ownership of Intellectual Property 
    
    - Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
    
    
    9. Period of the proposed contract or delivery date 
    
    - The proposed contract is for a period of one (1) year, from the date of contract award, and includes an option to extend the contract period by four (4) one-year periods.

    11. Suppliers' right to submit a statement of capabilities 
    
    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    
    12. Closing date for a submission of a statement of capabilities 
    
    The closing date and time for accepting statements of capabilities is: September 10, 2018 - 14:00 EST

However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.

    The Crown retains the right to negotiate with suppliers on any procurement.
