    Advance Contract Award Notice
    
    1.	ACAN Explanation
    
    An Advance Contract Award Notice (ACAN) is a public notice
    indicating to the supplier community that a department or agency
    intends to award a contract for goods, services or construction
    to a pre-identified supplier, thereby allowing other suppliers
    to signal their interest in bidding, by submitting a statement
    of capabilities.  If no supplier submits a statement of
    capabilities that meets the requirements set out in the ACAN, on
    or before the closing date stated in the ACAN, the contracting
    officer may then proceed with the award to the pre-identified
    supplier..
    
    2. 	Definition of Requirement
    
    The Department of National Defence has a requirement for the
    supply of quantity 20 MetOcean air droppable Iridium Self
    Locating Datum Marker Buoys (iSLDMBs), NSN 5845-20-007-0371, P/N
    16129, NCAGE OEC85.  The contractor shall deliver a quantity of
    20 iSLDMBs as a single lot to DND.
    
    3.	Criteria for the Assessment of the Statement of Capabilities
    (Minimum Essential Requirements)
    
    Any interested supplier must demonstrate by way of a statement
    of capabilities that its iridium self locating datum marker
    buoys meet the following minimum essential requirements:
    
    The air droppable iSLDMB is an "A-size" Self Locating Datum
    Marker Buoy that provides in water performance based on the
    proven CODE/Davis style oceanographic surface drifters. The buoy
    is equipped with an Iridium bi-directional satellite
    transmitter, sea surface temperature sensor, and a GPS receiver
    and is able to communicate critical data in real-time to the
    Canadian Coast Guard (CCG) Rescue Center. The operating life is
    between 15-120 days depending on the required data transmission
    rate. To meet DND's air drop clearance requirements, the iSLDMB
    shall be configured for air deployment within a cylindrical
    housing with a diameter of 4 7/8 (+0, -1/8) inches and a length
    of 36 (+.125, -187) inches.  The iSLDMB as configured for air
    deployment (bare buoy) shall pass with no force other than
    gravity through a vertical right cylinder having an inside
    diameter of 4 15/16(+1/64, -0) inches and 4 ft long.  The bare
    buoy shall have a center of gravity of 14.5 inches +/- 10 % from
    the base, a ballistic coefficient of 12.3 +/- 1.0 lbs/ft2, and a
    mass of 16.5 lbs +/- 10%.
    
    4.	Applicability of Trade Agreements to the Procurement
    
    This procurement is subject to the following trade agreement(s)
    
    The Agreement on Internal Trade (AIT).
    
    5.	Government Contracts Regulations Exception and Limited
    Tendering Reason
    
    The sole source justification is based on the absence of
    competition for technical reasons and the goods can only be
    supplied by the proposed contractor and no alternative or
    substitute exists.
    
    The following limited tendering reasons pertain to this
    requirement:
    
    i) Government Contract Regulations, Part 1, Section 6, (d): 
    Only one person or firm is capable of performing the contract;
    
    ii) Agreement on Internal Trade (AIT), Article 506, 12. (b):
    Where there is an absence of competition for technical reasons
    and the goods or services can be supplied only by a particular
    supplier and no alternative or substitute exists.
    
    6. 	Ownership of Intellectual Property
    
    Intellectual Property will vest with the Contractor.
    
    7.	Proposed Delivery Date
    
    The proposed delivery date is 2 months ARO.

    9. 	Suppliers' right to submit a statement of capabilities
    
    Suppliers who consider themselves fully qualified and available
    to provide the services and/or goods described herein, may
    submit a statement of capabilities in writing to the contact
    person identified in this notice on or before the closing date
    of this notice. The statement of capabilities must clearly
    demonstrate how the supplier meets the advertised requirements.
    
    10. 	Closing Date
    
    The closing date for a submission of a Statement of Capabilities
    is June 17, 2013.

    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
    
    Documents may be submitted in either official language of Canada.
