Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Water Quality Monitoring and Surveillance Division (WQMSD) of Environment Canada currently leads the design, planning and implementation of all of Environment Canada’s national water quality monitoring. Real-time or remote sensing/monitoring is one component of this national program. Environment Canada has a requirement for the supply of an automated continuously operating on-line flow through sensor to measure total chlorophyll, green algae, blue-green algae, diatoms and cryptophyceae in water. The sensor will be installed at a remote outdoor site to monitor these target analytes to support Environment Canada’s science activities in the Great Lakes. Delivery of the system is required by March 31, 2016. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its product/system meets the following requirements: The system must: 1. allow for both yellow substance and turbidity correction. 2. be plug and play so field staff can service the instrument in less than one hour in remote environments while in the field. 3. have an integrated cleaning device to allow unattended operation for 6 months in the field. 4. operate through both touch screen and personal computer operation to allow quick and effective operation in remote environments (touch screen) as well as allow for personal computer operation through an RS232 serial communication port for data integration for more comprehensive operation and troubleshooting. 5. have analogue outputs for connection to an external datalogger to allow modem operation for remote access across our national network. 6. measure total chlorophyll [µg chl-a/l], concentration of green algae [µg chl-a/l], concentration of blue-green algae [µg chl-a/l], concentration of diatoms [µg chl-a/l], concentration of cryptophyceae [µg chl-a/l] allow for yellow substance correction and have a measuring range 0 - 200 µg chl-a/l. 7. be adapted to new (customized) algae classes. 8. feature an integrated cleaning device, a touch screen display, allow for PC operation with an RS232 serial communication port, have a minimum of four 20mA outputs to accommodate a data logger and allow for a modem option. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s): o Agreement on Internal Trade (AIT) o North American Free Trade Agreement (NAFTA) 7. Justification for the Pre-Identified Supplier The bbe AlgaeGuard is an online analyzer that uses detection techniques similar to the bbe Algae online analyzers currently in use by Environment Canada. It is a continuously operating on-line fluorometer that provides simple and rapid determination of chlorophyll in flow-through mode. The bbe AlgaeGuard is conceived as a plug & play device, measurements are automatically started using pre-defined parameters (auto-start function) or by pressing the start button on the touchscreen display. Real-time chlorophyll fluorescence measurements are comparable to wet chemical chlorophyll analysis. The algal classes are determined simultaneously and recorded as green algae, blue-green algae, brown algae (diatoms and dinoflagellates) and cryptophyceae. To improve the chlorophyll measurement the humic substances content is determined and automatically used for the turbidity correction. Yellow substances are also measured and used for correction. The current measurement data are shown on the display. A comprehensive analysis and evaluation of the data measured can be carried out by using the supplied bbe++ software and an external PC. Environmental Analytic Systems is the Canadian sole authorized reseller of the sensor manufactured by bbe Moldaenke, the Original Equipment Manufacturer (OEM), and the only known manufacturer of the required technology. No alternate systems capable of meeting all the required specifications are known. The bbe AlgaeGuard meets all the required specifications and for this reason, it is Canada’s intention to award a contract to Environmental Analytic Systems. 8. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - only one person is capable of performing the work. 9. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/orlimited tendering reasons are invoked under the: o Agreement on Internal Trade (AIT) - Article 506 12(b) o North American Free Trade Agreement (NAFTA) - Article 1016 2(b) 10. Period of the proposed contract or delivery date The product/system must be delivered by March 31, 2016. 12. Cost estimate of the proposed contract The estimated value of the contract, including option(s), is $30,165.00 (HST extra). 13. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 15. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is February 3, 2016 at 2:00 p.m. EST. 16. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
