    1.Advance Contract Award Notice (ACAN) 
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2.Definition of the requirement 
    
    Environment and Climate Change Canada (ECCC) has a requirement for the supply of one Portable Greenhouse Gas and Ammonia Soil Flux Analyzer (GGA), including installation, warranty, and maintenance and support services.
     
    3.Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    
    Any interested supplier must demonstrate by way of a statement of capabilities that its product meets all of the following requirements: 
    
    1. Gas Concentration Analyzer (GGA)
    a. GGA must be configured for use in Canada and be Canadian Standards Association (CSA) approved.
    b. GGA must be able to simultaneously measure N2O, CO2, NH3 and H2O in a gas sample
    c. GGA must be portable so that it could be used in lab or field experiments 
    d. GGA must be able to measure all gas samples within 10 minutes.
    e. GGA must be able to operate under field conditions during the growing season (10 - 35 °C).
    f. GGA must be able to analyze gas samples that are between the temperature range of 0°C - 40°C.
    g. GGA must be able to operate in field conditions with high humidity (<85% RH) in the air.
    h. GGA must be able to accommodate gas samples with high humidity (0-99% RH) without having to dry the samples prior to analysis. 
    i. GGA must be able to measure N2O concentrations between 0.3 ppm and 50 ppm range.
    j. GGA must be able to measure CO2 concentrations between 400 and 4000 ppm range.
    k. GGA must be able to measure NH3 concentrations between 6 and 650 ppb range.
    l. GGA must have silicoNert or equivalent coating to prevent ammonia adhesion to surfaces. This would improve ammonia sensitivity and performance. 
    m. GGA must have a small optical cavity less than 35 ml volume to minimize sample loss and have a fast response time. 
    n. GGA must come with a monitor that has at least a 19"display.
    o. An external pump should be supplied that is compatible with the GGA. 
    p. Electronic and/or hard copies of operation manuals for the GGA should be included.
    
    2.  Service & Support
    a. Onsite service must be available within 7 days
    b. Telephone support and software updates must be provided for the duration of warranty.
    c. The system must be under warranty for at least one year.
    d. The manufacturer must be able to provide parts and maintenance for the GCA for a minimum of seven years.
    
    4. Exclusions and/or Limited Tendering Reasons
    
    The following exclusion(s) and/or limited tendering reasons are invoked under the section of the trade agreement(s) specified:
    
    - Canadian Free Trade Agreement (CFTA) - Article 513.1(b) (iii) 
    - Canada-Colombia Free Trade Agreement - which defers to WTO-AGP Article XIII, 
    
    
    5.Justification for the Pre-Identified Supplier 
    
    The only known supplier of a Portable Greenhouse Gas and Ammonia Soil Flux Analyzer (GGA)  that meets all the above requirements is Piccaro, Inc., Santa Clara, CA. For this reason, it is proposed to negotiate this requirement with Piccaro, Inc.
     
    6.Government Contracts Regulations Exception(s) 
    
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".
    
    7.Exclusions and/or Limited Tendering Reasons 
     
    The following exclusion(s) and/or limited tendering reasons are invoked under the following: 
    
    • Canadian Free Trade Agreement (CFTA)  Article 513.12(b)(j);
    • World Trade Organization - Agreement on Government Procurement (WTO-AGP)  Article XV.1(b); and
    
    8.Period of the proposed contract or delivery date 
    
    The Portable Greenhouse Gas and Ammonia Soil Flux Analyzer (GGA) must be delivered no later than March 31, 2022.

    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    16. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    17. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    18. The Crown retains the right to negotiate with suppliers on any procurement.
