Trade Agreement: NAFTA/AIT/Canada-Peru FTA/Canada-Colombia FTA Tendering Procedures: Generally only one firm has been invited to bid Attachment: None Non-Competitive Procurement Strategy: Interchangeable Parts Comprehensive Land Claim Agreement: No Vendor Name and Address: Smith-Root Inc 14014 NE Salmon Creek Ave. Vancouver Washington United States 98686 Nature of Requirements: Title: Electrofishing Boat The Department of Fisheries and Oceans (DFO), Burlington, Ontario has a requirement for the supply and delivery of: i) Qty. 1, Smith-Root Electrofishing Boat, Model SR-21EH complete with a 7.5 GPP Console Mount, a control box, an enclosed Kohler Marine GPP generator, and accessories; ii) Qty. 1, Smith -Root Trailer Tandem Karavan SR-16-21 complete with accessories; iii) Custom hardtop cover over console and installation of electronics supplied by Canada; and iv) Install outboard motor with engine supplied by Canada. The Smith-Root Electrofishing Boat will be used as an integral part of DFO Asian Carp program to assess and monitor fish communities in non-wadeable habitats. The electrofishing boat has been an integral component of the assessment and monitoring program in the United States Asian carp program, along with other Canadian and US educational and government research facilities and programs. In support of the work occurring in the USA, DFO will use the Smith-Root SR-21EH to sample open water habitats in the Great Lakes basin and require a large, heavy-duty, safe vessel capable of dealing with demanding conditions in the Great Lakes basin. DFO currently have 2 Smith-Root, model SR-21EH boats in their facility. In addition, DFO currently have 3 Smith-Root SR-21 boats whose parts are fully interchangeable with the RS-21EH. Smith-Root is the only known source of supply for the proposed commercial grade electrofishing boat SR-21EH required for DFO project needs. For reasons of interchangeability with existing equipment, training, servicing, methods etc., it is proposed to negotiate this requirement with Smith-Root, Vancouver, WA manufacturer of the (21 foot heavy duty) SR-21 EH electrofishing boats and the SR-16-21 trailer tandem Karavan. The requirement is subject to the AIT/NAFTA and is excluded under limited tendering for the following reasons: Limited Tendering under the Agreement on Internal Trade is justifiable under Article 506.12(a) "to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licenses, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative. Limited Tendering under the Agreement on North American Free Trade Agreement is justifiable under Article 1016(d) "for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of inter changeability with already existing equipment or services, including software to the extent that the initial procurement of the software was covered by this Chapter." An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
