TITLE: Implant Satellite Transmitters Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 1. Definition of the requirement The Department of Environment Canada, Canadian Wildlife Services has a requirement for the supply of Thirty (30) Implant Satellite Transmitters designed specifically to be implanted into the abdominal cavity of small sea ducks species. Environment Canada has been working with several partners (Sea Duck Joint Venture, U.S. Fish & Wildlife Services (USFWS), U.S. Geological Service (USGS), Ducks Unlimited, Simon Fraser University) to mark and track the migratory movements of selected sea ducks species considered to be of management concern. Project goals are to link wintering areas with breeding and molting areas, to determine level of inter-annual site fidelity to those areas, and to map migratory routes. We do this by capturing birds on winter sites using floating mist nest and decoys and then having an experienced Doctor of Veterinarian Medicine (DVM) implant small satellite transmitters into the bird's abdominal cavity. The tagged birds are then tracked using the Argos system (CLS America). For this requirement, we will be tracking the Harlequin Ducks. This species weighs only 500-700g and therefore requires a relatively small transmitter. Harlequin ducks will be captured in spring near White Rock BC, prior to moving to their breeding grounds and they will be tracked for more than 1 year. 2. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements: The Implant Satellite Transmitters must have the following: A) Be small and light-weight B) An antennae set at an appropriate angle that will "fit" Harlequin Ducks C) Have a special duty cycle required to be programmed into the transmitters ( 3 hrs ON & 3 days OFF) Dimensions: Length: Max. 6 cm Weight: Max 35g Antennae: Angled at 30 deg to the posterior Power: 250 mW Transmit Hours: Minimum 900 hours Sensors: 1) Mortality 2) Activity 3) Temperature, and 4) Voltage Encasing: Polymeric casting 3. This procurement is subject to the following trade agreement(s) Agreement on Internal Trade (AIT) North American Free Trade Agreement (NAFTA) 4. Justification for the Pre-Identified Supplier Telonics is the only current manufacturer of small, light-weight implant transmitters (30g unit weight) with antennae angled at 30 degree specifically designed to be implanted into small bodied sea ducks. The unit is coated with an impermeable rubber/plastic layer to prevent moisture intrusion and shaped to conform to the coelomic cavity (inner gut) of a sea duck and able to indicate the special duty cycle required to be programmed into our transmitters (3 hours ON and 3 days OFF). These specifications were engineered by Telonics to meet Environment Canada's needs. We have deployed these same Telonics Inc transmitters during several projects and they have performed very well. The location data were of high quality and many of the units transmitted longer than their predicted lifespan, more than 2 years. This lifespan is needed to determine inter-annual site-fidelity levels. 5. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 6. Limited Tendering Reasons The following limited tendering reasons are invoked under the (section of the trade agreement(s) specified): Agreement on Internal Trade (AIT) - Article 506 Item 12b. Where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitue exists. North American Free Trade Agreement (NAFTA) - Article 1016 Item 2b. Where for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. 7. Period of the proposed contract or delivery date The equipment must be delivered on or before March 15, 2014. 8. Cost estimate of the proposed contract The estimated value of the contract is $52,000.00 (GST/HST extra). 9. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is on or before January 28, 2014 at 2:00 P.M. PST. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
