Trade Agreement: NAFTA/AIT/Canada FTAs with Peru/Colombia/Panama Tendering Procedures: Generally only one firm has been invited to bid Attachment: None Non-Competitive Procurement Strategy: Interchangeable Parts Comprehensive Land Claim Agreement: No Vendor Name and Address: Lab-Volt Ltee Lab-Volt Ltee Harbourview Business Centre 11 Bay Bridge Rd. 2nd Floor Belleville Ontario Canada K8P3P6 Nature of Requirements: 1) ADVANCE CONTRACT AWARD NOTICE (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2) DEFINITION OF THE REQUIREMENT The Department of National Defence has a requirement for the supply and delivery of the following LAB-VOLT product: quantity 1: 8842-10 Power Diode quantity 1: 8837-00 Mosfet Chopper/Inverter quantity 2: 9063-CO Data Acquisition/Control Interface quantity 1: 8931-00 Speed Sensor/Tachometer quantity 1: 8846-00 System Enclosure/ Power Supply quantity 3: 9056-10 Current/Voltage Isolator quantity 3: 9318-00 DC Servo Motor/ DC Tacho-Generator quantity 1: 9029-00 Chopper/ Inverter Control Unit quantity 1: 8110-20 Mobile Console quantity 3: 9127-10 Component Panel quantity 2: 8821-20 Power Supply quantity 1: 8960-CO Four- Quadrant Dynamometer/ Power Supply. Variant C The Canadian Forces Fleet School Esquimalt and Canadian Forces Fleet School Halifax both use LAB-VOLT trainers in their Electrical and Controls Training cells. The Department of National Defence requires goods for the IPMS Maintainer Course conducted at Canadian Forces Fleet School Esquimalt. The goods will be used in conjunction with existing LAB-VOLT equipment, so compatibility is imperative. 3) CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (MINIMUM ESSENTIAL REQUIREMENTS) Any interested supplier must demonstrate by way of a statement of capabilities that it can supply all of the equipment listed in 2) Definition of the Requirement. 4) APPLICABILITY OF THE TRADE AGREEMENTS TO THE PROCUREMENT This procurement is subject to the following trade agreements: - Agreement on Internal Trade (AIT) - North American Free Trade Agreement (NAFTA) 5) JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER Festo Didactic Inc. is the only known supplier of LAB-VOLT equipment. Only LAB-VOLT equipment can work with existing LAB-VOLT equipment in place at the Canadian Forces Fleet Schools. Canadian Forces Fleet School Halifax has already purchased new LAB-VOLT equipment of the same type, and it is essential that there be compatibility of systems in both Canadian Forces Fleet School locations. 6) GOVERNMENT CONTRACT REGULATIONS EXCEPTION(S): The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) "only one person is capable of performing the work". 7) LIMITED TENDERING REASONS The following limited tendering reasons are invoked under the: " Agreement on Internal Trade (AIT): Article 506.12 (a) "to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licences, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative; and Article 506.12(b) "where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists. " North American Free Trade Agreement (NAFTA): Article 1016.2(b) "where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; and Article 1016.2(d) "for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services". 8) DELIVERY DATE All deliverables must be received on or before May 30, 2015. Goods must be consigned to the destination specified in the Contract and Delivered Duty Paid (DDP) destination address at: Department of National Defence Canadian Forces Base Esquimalt Attn: Receiving Base Logistics Bldg 66 Colwood Victoria, BC V9A 7N2 Canada 9) COST ESTIMATE OF THE PROPOSED CONTRACT The estimated value of the contract is CAD $33,000.00, GST/HST extra. 10) NAME AND ADDRESS OF THE PRE-IDENTIFIED SUPPLIER Festo Didactic Inc. 11 Bay Bridge Rd. 2nd Floor Belleville, ON Canada K8P 3P6 11) SUPPLIER'S RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
