    Nature of Requirements:
    1) ADVANCE CONTRACT AWARD NOTICE (ACAN)
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.

    2) DEFINITION OF THE REQUIREMENT
The Department of National Defence has a requirement for the
supply and delivery of the following LAB-VOLT product:

    Variant C

The Canadian Forces Fleet School Esquimalt and Canadian Forces
Fleet School Halifax both use LAB-VOLT trainers in their
Electrical and Controls Training cells. The Department of
National Defence requires goods for the IPMS Maintainer Course
conducted at Canadian Forces Fleet School Esquimalt. The goods
will be used in conjunction with existing LAB-VOLT equipment, so
    compatibility is imperative.

    3) CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES
    (MINIMUM ESSENTIAL REQUIREMENTS)
Any interested supplier must demonstrate by way of a statement
of capabilities that it can supply all of the equipment listed
in 2) Definition of the Requirement.

    4) APPLICABILITY OF THE TRADE AGREEMENTS TO THE PROCUREMENT
This procurement is subject to the following trade agreements:
    - Agreement on Internal Trade (AIT)

Festo Didactic Inc. is the only known supplier of LAB-VOLT
equipment. Only LAB-VOLT equipment can work with existing
LAB-VOLT equipment in place at the Canadian Forces Fleet
Schools. Canadian Forces Fleet School Halifax has already
purchased new LAB-VOLT equipment of the same type, and it is
essential that there be compatibility of systems in both
    Canadian Forces Fleet School locations.

    6) GOVERNMENT CONTRACT REGULATIONS EXCEPTION(S):
The following exception(s) to the Government Contracts
Regulations is (are) invoked for this procurement under
subsection 6(d) "only one person is capable of performing the
    work".

an absence of competition for technical reasons, the goods or
services can be supplied only by a particular supplier and no
reasonable alternative or substitute exists; and
Article 1016.2(d) "for additional deliveries by the original
supplier that are intended either as replacement parts or
continuing services for existing supplies, services or
