Trade Agreement: NAFTA/AIT/Canada FTAs with Peru/Colombia/Panama Tendering Procedures: Generally only one firm has been invited to bid Non-Competitive Procurement Strategy: Exclusive Rights Comprehensive Land Claim Agreement: No Vendor Name and Address: Patlon Aircraft & Industries Limited 8130 Fifth Line Halton Hills Ontario Canada L7G0B8 Nature of Requirements: Arrestor Gear Parts W0125-15AAS3/A Bill Perkins Telephone No. - (204) 229-0634 Fax No. - (204) 983-7796 Title: Supply and delivery of Arrestor Gear Parts The Department of National Defence (DND) has a requirement for the supply and delivery of Arrestor Gear parts, kits and accessories for Stationary, Transportable and Mobile Arrestor Gear Systems currently in operation at various DND bases across Canada. The Arrestor Gear spare parts, kits, and accessories must be compatible with all the following ESCO Brand Arrestor Gear Systems: 1) BAK-12 2) MAAS (Mobile Aircraft Arresting system) 3) MRES system (Mobile Runway Edge sheave) 4) Light Weight Fairlead beams 5) Smart Arrest systems 6) Deflector sheaves 7) BAK-14 Systems Due to compatibility, interchangeability, and proprietary issues with the Original Equipment Manufacturer (OEM), Engineering Arresting Systems Corporation (ESCO), Public Works and Government Services Canada (PWGSC) intends to negotiate, on behalf of DND, a standing offer with the only authorized Canadian Distributor, Patlon Aircraft & Industries Limited. The spare parts, kits and accessories will be purchased on an as required basis to the only known source that can meet the mandatory requirements. The Standing Offer will be for a period of three (3) years with the option to extend for two (2) additional one (1) year period(s). The estimated value of the Standing Offer, including option years is $7,500,000.00, including GST. Suppliers who consider themselves fully qualified and available to meet the specified requirements may submit a statement of capabilities in writing to the Contracting Authority identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. It is exempt from NAFTA as it is not listed in Annex 1001.1b-1, Section B list of specified goods and WTO-AGP has the same exemptions listed in Appendix 1 of the agreement The following limited tendering reasons pertain to this requirement: GCR - PART 1, SECTION 6 (d) only one person is capable of performing the contract AIT - ARTICLE 506 12 (a) to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licenses, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative;. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
