The Department of Fisheries and Oceans / Canadian Coast Guard has a requirement for the provision of acoustic monitoring services at Churn Creek, BC.
The purpose of this Advance Contract Award Notice (ACAN) is to signal the government’s intention to award a contract for these services to Stswecem’c Xgat’tem Stewardship Department. Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the ACAN posting period.
If other potential suppliers submit a statement of capabilities during this ACAN posting period that meets the requirements set out in the ACAN, the government will proceed to a full tendering process on either GETS or through traditional means, in order to award the contract.
If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the pre-selected supplier.
Statement of Requirement
DFO has requirement for acoustic monitoring and site security services, consisting of the following:
DFO will provide expertise and all of the necessary equipment to conduct the acoustic monitoring project with the exception of laptop computers by Stswecem’c Xgat’tem First Nation technician to be working at any given time. DFO will provide necessary software to process sonar files.
Contract technicians to be given entry level training in the operation of an acoustic monitoring site including data file collection, download, interpretation, and analysis.
Contract resources to cover each of three daily shifts; 8am-4pm, 4pm-midnight, midnight-8am.
Day shift resources process recorded sonar files on-site at the DFO trailer.
Contract resources to cover after-hours on-site security by way of two 8 hr shifts daily; 4pm-midnight & midnight-8am.
Once data files have been processed, completed data collection sheets will be given to the DFO Fisheries Technician on-site.
Minimum Essential Requirements
Trade Agreements and Other Obligations
The requirement is subject to the Canadian Free Trade Agreement (CFTA) and exempt from the international Trade Agreements as a set-aside for minority businesses.
Government Contracts Regulations (GCRs) Exception and Limited Tendering Reasons
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) – Where only one supplier can do the work.
This requirement is set aside for Aboriginal suppliers in accordance with the Procurement Strategy for Aboriginal Business.
The bidder must certify in its bid that it is an Aboriginal business or an eligible joint venture as defined within the Procurement Strategy for Aboriginal Business.

There are no Security requirements for this contract.
Ownership of Intellectual Property (IP)
There is no Intellectual Property being created under this contract.
Period of the Proposed Contract
The period of the proposed contract is from award to November 1, 2020.
Cost Estimate
The estimated limitation of the proposed contract is $187,529.60 plus tax.
Suppliers’ Right to Submit a Statement of Capabilities
Suppliers who consider themselves fully qualified and available to provide the services and/or goods described herein, may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Closing Date for Submission of a Statement of Capabilities
Statement of Capabilities must be received no later than 2:00 PM Atlantic Daylight Saving Time, June 5, 2020. Submissions received after this date and time will not be accepted.
