    Notice of Intent to Award a Contract

    Notice is hereby given by the City of Abbotsford (“the City”) of its intent to award a contract to Net Zero Waste Inc. (“NZWA”) for the following services on behalf of the City:
     
    • Compostable Waste Processing Services
    Background

    The City issued RFP 1220-2022-2787 – Compostable Waste Processing Services (‘RFP”) on June 2, 2022, the RFP was closed on July 18, 2022. As per Section 5.2 No Tender of the RFP “the City may cancel the RFP process at any time until signing of a formal written contract”.

    The City is cancelling the RFP pursuant to the above-noted Section 5.2 and intends to issue a new competitive procurement process in 2023.

    Scope of Services

    Supply of composting facility, all labour, supervision, equipment and materials necessary to provide Compostable Waste Processing Services.

    The City provides curbside collection services of recycling, Compostable Waste and garbage to approximately 26,400 single-family homes and duplexes. The City intends to deliver the collected curbside Compostable Waste to the service provider’s composting facility for processing.  In addition to curbside compostable waste collection, the City offers a Yard Waste coupon program to homes included in the curbside program.  Annually, each home in the program is provided with six Yard Waste coupons where each coupon allows the resident to drop off up to one tonne of Yard Waste at the composting facility for no charge to the resident.  The tonnages from the coupon program would be recorded by the service provider and costs invoiced to the City.

    The scope of required services generally consists of the following requirements:
     
    1. Weigh all loads of comingled food waste and yard waste received from City Collection Vehicles at the service provider’s facility;
    2. Weigh all loads of yard waste dropped off by residents utilizing the Yard Waste Coupon Program at the service provider’s facility;
    3. Process co-mingled food waste and yard waste, using aerobic, anaerobic or other conversion methods to produce value Class “A” Compost;
    4. Supply and load Class “A” Compost for an annual Compost giveaway organized by the service provider; and
    5. Market and distribute all compost produced at the Composting Facility.

    Intent of Direct Award

    As the ongoing provision of services is critical to the City it will be extending its current agreement with NZWA for a period of 6 months with the option to extend for a further 6 months commencing January 1, 2023 at a total anticipated cost of $1,324,625 plus GST.

    The justification for the direct award includes the following factors:
     
    • Compostable waste collection and processing are essential services for the City and its residents.
    • The City cannot consider a disruption of essential services while a new competitive process takes place.
    Firms objecting must provide specific reasons for their objection. The firm’s ability to provide services of the same or better quality, within the required time frame will be the key criteria with regard to the consideration of firm’s objections.
