    Notice of Intent to Direct Award

    Notice is hereby given by the City of Abbotsford (“the City”) of its intent to direct award a contract to Kerr Wood Leidal Consulting Engineers (“KWL”) for the following services on behalf of the City:

     
    • Engineering Design and Construction Services for Sumas River and Canal Sediment Program.
    Background
    The November 2021 extreme weather event has caused flooding in various parts of the City, and most notably the widespread flooding in the Sumas Prairie, due to the Nooksack River overflow from Whatcom County in the United States. 
    As part of the post disaster recovery, The Province of British Columbia’s - Ministry of Environment and Climate Change (MOECC) through the Flood Debris Management Secretariat (FDMS) engaged Several Consultants across the Province to look at and provide recommendations for the removal of sediment and bank repairs to various creeks, streams, and rivers across the province. The FDMS engaged KWL to coordinate design, construction  and overall project management for the work associated in Sumas Prairie, including the Sumas River and Sumas Canal Sediment Removal Program.

    The works generally included:
    • Bank protection along Sumas Dike down stream of Atkinson Road
    • Sediment removal at Mckay Creek Confluence and Sumas Canal
    • Cole Road Dike breach repair
    • Various Dike Repairs
    • Debris removal along Sumas Dike
    • Repair Sumas River bank along Mckay Creek Trail
    • Sediment removal from Sediment Traps
    • Review and provide recommendation on Emergency Dike repairs
    • Short term dike improvements, assessments, Designs
    • Review sediment in Sumas River and Sumas Canal

    As the above mentioned projects move towards the construction phase, the MOECC has requested that the City of Abbotsford take ownership of the projects. As such the City of Abbotsford is posting this notice of intent to retain KWL as the owner’s consultant to continue with the work that has already been completed.

    Scope of Services

    The scope of required services generally consists of the following:

     
    1. Undertake Investigations / Preliminary and Detailed design at all of the sites
    2. Conduct environmental investigations and assessments
    3. Secure permits required to construct the project
    4. Provide services for Tendering, Construction and Post Construction works
    5. Provide Project Management for the project
    6. Undertake and assist with First Nations engagement
    7. Undertake and assist with regulator and stakeholder engagement
    8. Attend consultation meetings
    9. Respond to questions and provide technical support during the consultation process

    Intent of Direct Award

    As the ongoing provision of services is critical for public safety, the City intends to award the engineering services support to KWL up to a total anticipated cost of $3,300,000 plus GST.

    The justification for the direct award includes the following factors:

     
    • Public safety concerns as delays increase the risks of Sumas Prairie exposing to the same magnitude of flood risk seen in November 2021
    • KWL has been hired by the Province to undertake these works and have been involved with the Project since August/September 2022. With works in various stages of design and Construction and changing consultants at this time would put the project and timelines at risk
    • KWL completed various studies on the Sumas Prairie, including the recent long term flood mitigation options for Sumas Prairie, 2018 Drainage Master Plan, and the 2020 Nooksack River Overflow Flood Mitigation Plan.  In addition, KWL has provided technical support to the City during the November 2021 extreme weather event.
     
    Firms wishing to object to this NOI must email their objection to the attention of Timothy McBride, Manager, Procurement at purchasing@abbotsford.ca . The deadline for objections is set for July 31, 2023, before 2:00 p.m. PST.

    Emails must include specific reasons for the objection that address the justifications noted above. The firm’s ability to provide services of the same or better quality, within the required time frame will be the key criteria with regard to the consideration of a firm’s objections.
