    1. Advance Contract Award Notice (ACAN)
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    Any interested supplier must demonstrate by way of a statement of capabilities that its product/equipment/system (as appropriate) meets the following requirements of items listed in section 2 above – Definition of the requirement.

    5. Justification for the Pre-Identified Supplier
    The SPECIALIZED FLIGHT CLOTHING AND ACCESSORIES as sought by the Department of National Defence on this procurement (as outlined under part 2) are only manufactured by one supplier, Mustang Survival Corp. The Department of National Defence has determined that Mustang Survival Corp. is the only source capable of manufacturing these NSNs as it is the only supplier that possesses the requisite expertise and experience in the production of these items.

    6. Exclusions and/or Limited Tendering Reasons
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".
    7. The following exception to the Government Contracts Regulations are invoked under the
    Chapter 5 article 513(b)(iii)of the CFTA is applicable on the basis of limited tendering where the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist due to an absence of competition for technical reasons.

    Article 15.10(2)(b) of the CPTPP is applicable on the basis of limited tendering under the circumstance that the good or service can be supplied only by a particular supplier and no reasonable alternative or substitute good or service exists due to the absence of competition for technical reasons.

    Article XIII(b) of the WTO-AGP is applicable on the basis of limited tendering following circumstances where the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist due to an absence of competition for technical reasons.
    8. Ownership of Intellectual Property
    Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
    9. Cost and period of the proposed contract or delivery date
    The estimated value of the contract is $3,041,090.00 CAD (taxes excluded), Delivery of items to begin by the end of March 2024.

    11. Suppliers' right to submit a statement of capabilities

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    12. Closing date for a submission of a statement of capabilities
    The closing date and time for accepting statements of capabilities is December 6, 2023 at 2:00 p.m. EST.
