    Description
    The National Capital Commission (NCC) has a requirement for the purchase of LED lighting fixtures that can light structures and buildings in an array of colors for events, festivals and special projects within the National Capital Region. In addition to lighting, these units must be able to receive wired and wireless DMX transmission, be operational in Canadian winter weather equally as well as rain and hot weather. These fixtures also require specific power, optical and color range capabilities. 
    
    The purpose of this Advance Contract Award Notice (ACAN) is to signal the NCC’s intention to award a contract for the purchase of 16 DTS Delta 12FC high powered LED projector units to the sole Canadian distributor of DTS products.

    Before awarding a contract, however, the government provides other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the fifteen (15) calendar day posting period. 
    
    If other potential suppliers submit statements of capabilities during the fifteen (15) calendar day posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
    
    If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the pre-selected supplier.
    
    This request consists of procuring the following goods:
    
    Supply and deliver to the National Capital Commission 16 Delta 12FC LED projector units 
    
    The delivery date for the goods is no later than November 22, 2013 to the NCC warehouse located at 84 Bayview Road in Ottawa, Ontario. 
    
    The estimated value for this contract is approximately $53,500.00 including taxes.
    
    NOTE:   Following the adoption of the Economic Action Plan 2013 Act, No.1, (Bill C-60), S.C., 2013, c.33, (the ’’Act’’) implementing the 2013 Federal Budget, the National Capital Commission’s event and activity mandate will be transferred to the Department of Canadian Heritage. As provided for under section 219 of the Act, and to the extent that they relate to the activity and event mandate, the NCC’s assets will be transferred to and the NCC’s obligations will be assumed by Her Majesty in right of Canada, as represented by the Minister of Canadian Heritage, effective September 30, 2013.  The contract resulting from this ACAN falls within the framework of the services that are being transferred to Canadian Heritage.
    
    Any other potential supplier shall demonstrate by way of a statement of capabilities that its product meets the following:
    •	Minimum output of 26,000 lumens at 5 meters.
    •	Color temperature range of 2700 K to 8000 K and 16 million colors.
    •	Must be LEDs fixture containing RGBW
    •	Must have a full range auto switching power supply from 90-260V and 50-60 Hz. 
    •	Must have wired and wireless DMX capabilities. 
    •	The units must have a minimum rating of IP65.
    •	The units must have a lens or optical range of Very Narrow to Wide.
    •	The units must be CSA or ULc certified for use in Canada.
    •	The units must be delivered with an L6-15 250v connector installed. 
    •	Demonstrate that he can meet the delivery date indicated herein.
    
    L.I.T.E. 3 Inc. is the only supplier known to be capable of meeting the lighting fixtures specifications and supplying the required goods.  Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    This requirement falls within the exemptions under the Government Contracts Regulations: 
    10.2.1(d) only one person or firm is capable of performing the contract and under the Agreement on Internal Trade (AIT), Chapter 5, Article 506, 12(a) to ensure compatibility with existing products.
    
    The procurement process for this requirement is subject to Chapter 5 of the Agreement on Internal Trade (AIT).
    
    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board’s electronic bidding authorities. If other potential suppliers submit statements of capabilities during the fifteen (15) calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.
