ADVANCE CONTRACT AWARD NOTICE (ACAN) 1. REQUIREMENT Foreign Affairs, Trade and Development Canada has a requirement for the provision of legacy and digital television services for existing outlets located at Lester B. Pearson, 125 Sussex Drive and at John G. Diefenbaker 111 Sussex Drive, Ottawa, Ontario. The requirement includes legacy and digital television service distribution to approximately 450-500 existing outlets with the capability to add or remove outlets on an “as and when requested” basis based on operational requirements. Services must be distributed to each location using the existing coaxial or fiber distribution system. Due to government security restrictions, wireless signal distribution will not be allowed. Services must also be distributed for the INFO60 and VIDEO61 internal broadcasting channels that are managed by the department. 2. PURPOSE OF THE ADVANCE CONTRACT AWARD NOTICE (ACAN) The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for these services to: Rogers Ottawa Ltd. 475 Richmond Road Ottawa, Ontario K2A 3Y8 Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the fifteen (15) calendar day posting period. If other potential suppliers submit a statement of capabilities during the posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract. If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the pre-selected supplier. 3. PERIOD OF THE PROPOSED CONTRACT The proposed contract is for a period of one (1) year from August 2014 and includes the option to extend the contract by two (2) additional periods of one year each. 4. ESTIMATED COST The estimated cost of the contract, including the option periods, is $420,000 (HST extra). 5. JUSTIFICATION FOR THE PRE-SELECTED SUPPLIER These services are regulated by the Canadian Radio-television and Telecommunications Commission (CRTC) and Rogers Ottawa Ltd. is the only supplier that has been granted a license by the CRTC to provide these services at the Sussex Drive location. Furthermore, to ensure compatibility with existing infrastructure and equipment it is the intent of the department to contract with Rogers Ottawa Ltd. Applicable Exceptions to Soliciting Bids under the Government Contracts Regulations (GCRs): The following exception to the Government Contracts Regulations is invoked for this procurement: subsection 6(d) only one person is capable of performing the contract. Applicable Limited Tendering Provision under AIT (Article 506.12) This requirement is subject to the Agreement on Internal Trade (AIT). The limited tendering provisions contained in AIT Article 506, paragraph12, subparagraphs (a) and (b) apply to this requirement. 506.12(a) - to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licenses, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative 506.12(b) - where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists 6. INQUIRIES AND SUBMISSION OF STATEMENTS OF CAPABILITIES Suppliers who consider themselves fully qualified and available to meet the specified requirements may submit a statement of capabilities in writing to the Contracting Authority identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The closing date and time for accepting statements of capabilities is June 18, 2014 at 2:00pm EDT.
