    Description
    1.   Advance Contract Award Notice (ACAN)
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities.  If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    2.  Definition of the requirement
    
    The Department of National Defence (DND) has a requirement to train CBRN Operators as Laboratory Technicians in the following three streams:  Chemical Engineering Technician, Biotechnology Technician and Environmental Technician. DND will determine which stream the student will enter before beginning the program. 
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    
    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
    
    M1)  Must be a recognized college as defined by the Ontario Ministry of Training, Colleges and Universities;
    
    M2)  The facility must be within a 50km radius of CFB Trenton;
    
    M3)  Must currently offer or will offer in September 2014 an Environmental Technician, Chemical Engineering Technician AND Biotechnology Technician program;
    
    M4)  All courses must be conducted and completed during the regularly scheduled academic year.  During the academic year, students must be on full-time status;
    
    M5)  The College Diploma program must be two years in duration, and upon completion, students must be granted a two-year Ontario College Diploma; and
    
    M6)  The courses within the program must be provided in English.
    
    4.  Applicability of the trade agreement(s) to the procurement
    
    This procurement is subject to the following trade agreement(s)
    • Agreement on Internal Trade (AIT)
    • North American Free Trade Agreement (NAFTA)
    
    5.  Justification for the Pre-Identified Supplier
    
    Loyalist College is the only college within a 50km radius of CFB Trenton that offers all three streams of Laboratory Technician (Environmental, Chemical Engineering and Biotechnology).  
    
    6.  Government Contracts Regulations Exception
    
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) “only one person is capable of performing the work”.
    
    7.  Exclusions and/or Limited Tendering Reasons
    
    The following exclusion and/or limited tendering reasons are invoked under the 
    • North American Free Trade Agreement (NAFTA) – Article 1016: Limited Tendering Procedures 2.(b)
    • Agreement on Internal Trade (AIT) – Article 506: Procedures for Procurement 12.(a)
    
    8.  Ownership of Intellectual Property
    
    Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
    
    9.  Period of the proposed contract
    
    The proposed contract is for 1 year from September 2014 to August 2015 with four (4) one (1) year option periods.
    
    10.  Cost of the proposed contract
    
    The estimated value of the contract, including option periods is $125,000.00 for tuition and all necessary supplies including textbooks, lab coats and safety glasses for up to 4 students per semester.

    12.  Suppliers’ right to submit a statement of capabilities
    
    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    13.  Closing date for a submission of a statement of capabilities
    
    The closing date and time for accepting statements of capabilities is 26 June 201, 2:00 pm EDT.
