Supply Agreement of Standards for the Medical Devices Bureau

1.  The purpose and explanation of an ACAN

An Advance Contract Award Notice (ACAN) allows Health Canada contracting authorities to post a notice on MERX, for no less than fifteen (15) calendar days, indicating to the supplier community that a good, service or construction contract will be awarded to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.

2.  Rights of suppliers

Suppliers who believe that they are fully qualified and available to provide the services or goods described in this ACAN may submit a Statement of Capabilities clearly demonstrating how they meet the advertised requirement. This Statement of Capabilities must be provided via e-mail only to the contact person identified in Section 12 of the Notice on or before the closing date and time of the Notice. If there is a reasonable level of evidence regarding capability, the requirements will be opened to electronic or traditional bidding processes.

4.  Definition of Requirements or Expected Results

IHS has developed a custom package specifically designed for the medical device industry.  This is a cost effective package that provides electronic access to all Medical Devices Bureau (MDB) staff of most of the recognized standards included in the list of recognized standards by MDB that address the wide range of needs within MDB.

This package also includes relevant standards that are not included in the list of recognized standards, but that are frequently used by global medical device manufacturers in the design, development, verification and validation of medical devices. 

MDB needs access to standards on a daily basis.  IHS provides a service that makes the most current standards readily available for all staff members of the MDB team.

5.  Minimum requirements

Any interested supplier must demonstrate by way of a Statement of Capabilities that it meets the following minimum requirements: 

The requirements for this contract are for IHS to provide on-going access to their web-based portal to allow MDB staff to access these standards.  As this is an on-going service provided daily, there are no other milestones to be met for this contract.  This contract will be for the provision of one year of access to the standards that are included in the following packages:

		MEDAS:	DEVICE STANDARDS LIBRARY – ASTM (ACTIVE)
		MEDS2:	DEVICE STANDARDS LIBRARY - IEC
		08ISO		ISO – Medical – Active/Historical
		CC1D6	Custom Collection

6.  Reason for non-competitive award

Only one company is able to supply all the information required. 

7.  Applicable trade agreements and justification for limited tendering or the Procurement Strategy for Aboriginal Business

8.  Ownership of Intellectual Property

The Contractor will own Intellectual Property.

9.  Period of the proposed contract

The contract is for a period of one year from the date of award.

10.  Estimated value of the proposed contract

 “The total estimated value of the proposed contract should not exceed $23,545.00 US per year, including travel and living expenses (if applicable), and all applicable taxes.”


11. Closing date and time 

The closing date and time for accepting Statements of Capabilities is the  05 day of January, 2015,  (2 p.m. EST).
