ADVANCE CONTRACT AWARD NOTICE (ACAN) 1. Definition An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their Statement of Capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board's electronic bidding authorities. If other potential suppliers submit Statement of Capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract. 2. Definition of Requirements The objective of the service contract is for the repair and preventative maintenance of two (2) Agilent ICP-MS Systems as follows: The service includes: 1. Hardware and software technical support by phone, email, or on-site visit when required. 2. Unlimited on-site instrument repairs. 3. Preferred response for time-and-materials service calls to expedite the resolution of our instrument service requests. 4. One annual preventative maintenance (PM) visit to help maintain the peak performance of our instrumentation. The annual PM is to include inspection, cleaning, calibration (when applicable) and complete operation instrument check to ensure optimum performance. 3. Trade Agreements There is no trade agreement impacted with this contract. 4. Title to Intellectual property Agilent owns the intellectual property rights to the Mass-Hunter Software that controls and operates the instrument and collects the data. The Vendor has not licensed this software to any third party provider. 5. Contract Period The period of the contract will be from contract award to March 12, 2016, with one (1) option to renew. The cost of the option is to be determined at the time of exercising the option, but it is estimated at the current year cost for approval purposes. 6. Estimated Cost The estimated maximum value of the contract is $74,769.28 CAD inclusive, (which includes $37,348.64 for the first year and $37,348.64 for the option year). 7. Exception to the Government Contracts Regulations and applicable trade agreements (d) Only one person or firm is capable of performing this contract. The Vendor (Agilent Technologies Canada Inc) owns the intellectual property rights to the Mass-Hunter Software that operates the instrument (owned by Natural Resources Canada). The equipment and the software are proprietary to the vendor and no alternative to the vendor exists to service this equipment. Also, the 7700 ICP-MS and the 8800 ICP-MSMS are equipped with Agilent’s patented High Matrix Introduction (HMI) technology and Agilent’s patented Shield Torch System (STS). Agilent is the only manufacturer of the ICP Triple Quad systems and all these Intellectual Properties are not licensed to any third party providers. This requirement to service the equipment may require patches or software upgrades, which only Agilent can provide since it owns the IP rights. Only Agilent Technologies and its technical staff have been trained to provide the services and Preventive Maintenance of the specialized Instruments. 8. Inquiries on Submission of Statement of Capabilities "Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a Statement of Capabilities in writing, preferably by e-mail, to the contact person identified in this Notice on or before the closing date and time of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements." 10. Closing Date The closing date for a submission of a Statement of Capabilities is March 20, 2015 at 14:00 Mountain Standard Time (MST). 11.
